Absent a statute preventing it, it is legal in all states. The 4th amendment is based upon a "reasonable expectation of privacy." I don't think an argument that you have any expectation of privacy, let alone a "reasonable" one, in a can or bag of trash that YOU PUT OUT ON THE SIDEWALK FOR ALL TO SEE AND SMELL, can be made with a straight face. Good advice though. My last drop was at a dentist's office about 5 miles from my house, and it is always different.
