Basic Legal Common Sense for MMJ Tennants

    Hi,

i am new to this forum because, well, i don't use mj as i don't care for the side-effects. however, i have always known that it should be 100% legal. ESPECIALLY for medical purposes. i am a landlord and have never had a problem with my tenants using mj.

now i have a couple who wish to grow for mmj purposes. imho, they don't really think thye qualify as candidates, but i'm not the doctor they allegedly paid to say they do need it. if they are 100% faking it, it's not my business, however I do feel that it cheapens the legit mmj patients and gives a stronger case for the anti-mmj folks. i just need it to be legal for my purposes. anyway, moving on...

this couple has been growing their plants for about a month and i keep asking them for their "papers and permit", not really knowing what I am asking for. today, they gave me three papers: Attention Law Enforcement; Attention Law Enforcement (Designated Provider) and; Designated Provider Authorization. they say they can't find the prescription their doctor filled out for them but they will find it very soon.

Now, I am pretty sure you can print the aforementioned forms out from the internet - the Doctor's note is what I need. Is the prescription an actual "permit"? I am under the impression that they need to pay the doctor's fee and then they will get some sort of permit, like they do in California.

Can someone correct me? Tell me I am an idiot and they really just in need of a "prescription" where i will never see the actual paper.... i want to believe them, but i have a feeling they are lying to me...

again, i just need this to be legal so i do not loose my house. i have felt what ass-faced cops can to to make my life miserable and secretly I would love to shove some sort of permit in their faces so they can't harass my tenants... one can dream.

any help would be greatly appreciated - thank you!!

There is no prescription form because there is no legal prescription for mmj. All they'll have if they're legal is a MJ Authorization form with there name and a doctors signature on the bottom. The problem is you'll have to pretty much take there word for it being legit because the form is very easy to forge.

thank you very much for your quick reply. so it's not a permit, like they have in CA...

the problem i have with letting them forge a document is that it makes the folks that really need mmj look like they are forging their pain. i wish i could remember the name of this documentary that I just saw about the war on drugs - it was a bit long but the end showed how many people's lives can be ruined because of the current laws. anyway, it makes me pretty mad and crazy.

thanks again, i have a lot to think about.

Give them a 30 day notice for illegal drug use on your property. also note in the notice that if they provide you with a "doctors recommendation" for the use in Wa. St. and you can verify this in writing from the business they received it from , with them(your tenant) signing a release of information(strictly stating they are legit) then at least if shit hits the fan with LEO your covered.:thumbsup::thumbsup:

Then you can shove a big stick in any LEO's ass.

As for the tenant, I hope it is not from any doc in the box.(which of course you should not concern yourself with as a landlord it's not your legal issue, but theirs)

Hope this answers your concerns as a landlord. Merry x-mas
