    DUI for Pot?

    Hypothetical- Assume found NOT in possession. If one is just completely blitz (eyes shot & uncontrollable highness) and gets busted for erratic driving or there is a traffic accident, can they test for marijuana levels? How is the test done? What is the "legal limit"? Does the standard 50ng/mL apply? What ng/mL levels would one have immediately smoking out?

    DUI for Pot?

    States are really beginning to change there laws on this. Is used to be that they could not do a blood test with a court order but that is changing. And really a blood test is the only way to really tell if someone is under the influence of any substance. The problem is the science still isn't good enough to say conclusively you were under the influence and until that happens its really not very good evidence in a court of law.

    Just some food for thought,

    There are a few states, I believe CA, AZ, and Utah, as well as a few others, that if you are involved in an injury accident, then they do an automatic blood test, and if you test positive for thc metabolites, then you are charged w/ a DUI, regardless of whether or not you were high at the time. Saying that you could have not smoked for a few weeks, and still catch that charge.:stoned:
