Sue the State of Washington?
Hi,
How about sueing the State of Washington.....being a patient, the state is causing me pain and suffering.
If the State insists on harassing our providers we should sue, this is the only thing the state understands.
The voters have spoken! Is the State violating the law? Is the State above the Law?

Sue the State of Washington?
A class action lawsuit would work best. That way the attorneys could get involved and have there proper motivation to join the cause.lol
It would be hard. Trying to get it infront of an unbiased judge would be difficult.

very hard for me to watch a elderly woman in my family suffer from cronic pain and being on extreme amounts of morphine patches, and they arn't working any more, she is selling her home to afford her portion of the medication, 2000 dollars a month, and still in pain, its criminal to treat our elders like this, and very frustrating for those of us that love them.

The only viable course is through either an initiative or legislation. An initiative would work sooner since the legislator's are dragging their feet now. The state, per se, has immunity under the law. I'm surprised someone isn't writing an initiative up now because now is the time to get one going. Money to gather signatures should be easy to get especially for successful gray area co-op! And, I'm sure you would have to pay many to gather signatures. Every medical patient should consider it a duty to gather for free. :thumbsup:

RCW 4.24.630 is the teeth of our MUMA, the timber trespass statute. It provides:
(1) Every person who goes onto the land of another and who removes timber, CROPS, minerals, or OTHER SIMILAR VALUBLE PROPERTY FROM THE LAND, or wrongfully causes waste or injury to the land, or WRONGFULLY INJURES PERSONAL PROPERTY or improvements to real estate on the land, IS LIABLE TO THE INJURED PARTY FOR TREBLE THE AMOUNT OF THE DAMAGES CAUSED BY THE REMOVAL, waste, or INJURY. For the purposes of this section, a person acts "WRONGFULLY" if the person intentionally and unreasonably commits the act or acts while knowing or having reason to know, that he/she lacks authorization to so act.(the plain language of the act does not authorize search & seizure warrants nor allows for forfeiture of ANY PROPERTY). Damages recoverable under this section include, but are not limited to, damages for the market value of the property removed or injured, and for injury to the land, including the costs of restoration. In addition, the person is liable for reimbursing the injured party for the party's reasonable costs, including but not limited to investigative costs and reasonable attorney's fees and other litigation related costs.
For more than a centery, Washington has recognized that the willful and illegal cutting of timber subjects an individual to treble damages. RCW 64.12.030 (ORIGINALLY, LAWS OF 1869,P.143,SEC. 556,RSS SEC. 939.) The statute provides:
Whenever any person shall cut down, girdle or otherwise injure or carry off any tree, timber or SHRUB ON THE LAND OF ANOTHER PERSON, or on the street or highway in front of any persons house, village, town, or city lot, or cultivated grounds, or on the commons or public grounds of any village, town, city or on the street or highway in front thereof, WITHOUT LAWFUL AUTHORITY, in an action by such person, village, town, or city against the person committing such trespasses or any of them, if judgment be given for the plaintiff, IT SHALL BE FOR TREBLE THE AMOUNT OF DAMAGES CLAIM OR ASSESSED THEREFOR, AS THE CASE MAY BE.
This is upper and lower fangs to show LEO they can't steal from us patients any longer, it goes against the officer and NOT THE STATE, it's not the state whom is harming us, it's individual officers of the courts system whom are not immune from huge damages. For example, say officer A takes your 15 plants and your a qualifying patient with valid documentation, the task forces have given a value of $4,800 per plant when they bust someone, X that by 3, then times that by 15. That's $180,000 in damages just for taking your plants, not to mention the damage for your severe pain reaching the levels of torture which is consistent with assault 2 under wa. laws.:smokin:

I'm all for a class action lawsuit. I know of quite a few MMJ patients who have been harmed by leos and should be compensated.

KW420,send me the info you have that gives rise to this class action you say should compensate the Washington mmj patients that you know of. [email protected],NOT JUST SOMEONE EXPLAINING THEIR CASE> I WANT DOCUMENTATION FROM LEO,COURT,LAWYER etc., then I can be of assistance.:thumbsup:

I would of course never release someone elses personal information about there involvment with leo. That is for them to do, not me. I would never put someone elses life in danger.

Kb420, just incase your not on the same pg., of coarse one would expect you to read this as, WHATS ALREADY PUBLIC INFORMATION AND NOT PERSONAL INFO... S..T OR GET OFF THE POT MAN? THIS IS SERIOUS BUSINESS, NOT A CHILDS GAME... When you become part of a class action, many peoples personal life become up for grabs in the media etc.. So maybe have your peeps contact my peeps, and cut the messenger out of the action.:thumbsup:

about 2 years ago, my neighbor was raided, taken to jail and all of his medicine distroyed.
can I get these records as part of public knowlage?
What do I need to ask?
live in a little town that gives little regard to personal rights
I would like to make it stop!
