    A primary care giver question

    I've got a buddy, almost 40 years, who lives in L.A. county in CA. I currently live in GA. He and his wife have a big place and he offered to rent me a room so I could buy legally, something I CAN'T do in Georgia. I have MS and most of the time, I can take care of myself. Sometimes not. I was gonna designate him as a primary caregiver for the times I'm laid up. If I designate someone as a primary care giver, am I always dependent on them getting me meds whether I could do it myself or not, or can I get my own when I'm able and just depend on my buddy when I absolutely have too? The guy has a family and I want to be as little a problem as possible.

    I'll try my best to answer, I haven't seen a lot of information on this subject. From what I know you'll need your recommendation from a cannabis friendly doctor either way. I saw an advertisement for a doctor in the Bay area who charged $50 to be a caregiver for a patient.
    Your friend could go in with you on the same day of appointment and let them know you want him to be your caregiver seeing how you can be immobile at times. You'll both have different documentation, he can go buy it for you when needed, and you can go as well with your valid recommendation. There should be delivery services in the L.A county area if needed, there's someone here in Sac that provides to patients, who can't always make it to the store. My girlfriend has a doctors appointment tomorrow, I'll see if he says anything about care givers!! Hope that helped at least!!!:jointsmile:

    In California your primary caregiver needs to live in the same county and provide you with medical related services that go beyond providing you with just cannabis. Because you would technically be living with your primary caregiver, I think this would help you in a court of law. This would only really matter in court. If, for some reason, you needed to validate your relationship with your primary caregiver in a court of law, you would need that person to do more than just provide you cannabis.

    Check it out, these are Jerry Brown's (Attorney General of California = Head of all law enforcement) law enforcement guidelines concerning MMJ.

    Here is the section on primary caregivers from the pdf linked above as of August 2008:

    B. Primary Caregiver: A primary caregiver is a person who is designated by a qualified patient and ??has consistently assumed responsibility for the housing, health, or safety? of the patient. (§ 11362.5(e).) California courts have emphasized the consistency element of the patient-caregiver relationship. Although a ??primary caregiver who consistently grows and supplies . . . medicinal marijuana for a section 11362.5 patient is serving a health need of the patient,? someone who merely maintains a source of marijuana does not automatically become the party ??who has consistently assumed responsibility for the housing, health, or safety? of that purchaser. (People ex rel. Lungren v. Peron (1997) 59 Cal.App.4th 1383, 1390, 1400.) A person may serve as primary caregiver to ??more than one? patient, provided that the patients and caregiver all reside in the same city or county. (§ 11362.7(d)(2).) Primary caregivers also may receive certain compensation for their services. (§ 11362.765(c) [??A primary caregiver who receives compensation for actual expenses, including reasonable compensation incurred for services provided . . . to enable [a patient] to use marijuana under this article, or for payment for out-of-pocket expenses incurred in providing those services, or both, . . . shall not, on the sole basis of that fact, be subject to prosecution? for possessing or transporting marijuana].)
