Hash-Felony charge for .08 grams!?-Help!

Well I picked up a felony charge for hash in SD. I'm taking it to trial if the felony is not dropped but the only grounds I have to fight it on is what constitutes hash? Can I tell them I mixed ash with resin and hope they are that stupid? What are the chemical differences between pot and hash, if there are any? Any help on ways to handle this case would be greatly appreciated.

Well, seeing as you are taking it to court, they are going to keep the evidence, your hash. And I imagine that if you said that, they wouldn't give a rats ass how dumb you thought they were, they wouldn't believe it; especially if any of them are smokers(tobacco) seeing as they know what resin is/smells like.

The reason Hash gets you in more trouble than weed is because you have to process the marijuana or leaves to make hash....its no longer considered a natural product... even if you use water ice and bags to make the hash... whoever made the hash changed the natural state of the marijuana.... condenced it

I would argue - and I don't know that this will sway anyone that honestly thinks a felony charge for 8 hundredths of a gram of hash is an appropriate charge - that hash is just as natural as the bud itself. I consider "processing" to mean that something is added or taken away from something to make the end product different from the natural product, like processed cheese, or processed chicken. On the contrary, hash is simply a collection of the resin heads naturally produced by the plant. Of course hash is more potent and has more THC than the bud, but it is still a product from the plant that is produced naturally. If you were caught with .08 g of chopped up and compressed buds, would that be processing, and therefore worthy of a stiffer charge? Where is the rationality here?

BTW, is SD San Diego or South Dakota?

I believe that is South Dakota. And they have alot more stiffer/harder charges when it comes to drugs. They are really emo about drugs in there state, as it is alot harder to come across. This makes it more appealing to go make money there for them type of people, But if they make charges harsher this would likely mean less people that would wanna go there to profit.!:jointsmile: I have heard this from 3 of my friends that use to live there, An another one of my friends say ND has stricter laws than most states but not as bad as SD.
I am not 100% sure of the actual laws but I remember from school that SD laws are kinda screwy compared to the surrounding states.

Take it to the jury. Just by wasting the courts time over such a small amout will get you a better plea bargain. Stand tall and insist on the jury. Make sure you wate all the time you can and remember that 90 percent of all court cases are settled out with plea bargains. If they did not do deals for things like this the courts would be sooo tied up you might not get there for many years.
