currently US law considers ANY part of the plant to be illegal, dead or alive, aside from the seeds; which are legal if they are sterile.

all depends which state you're in, it's quite unlikely you're going to encounter federal agents, if you're in oklahoma I'd say yeah..I've had friends get busted for seeds and a couple "flakes"
