    Im not sure if this is the right thread and if not i want to apologize now.

    But here is my question..

    I have a cousin who just went Awol and in my opinion i dont believe in it but it was his choice and im worried about what is going to happen to him.

    He has been Awol now for 3 months and says he wont go back until august.

    Anyone have any idea how much time he can get or what his punishment would be?

    Not sure for how long, but from what I know it's either The Brigg(sp?) or Dishonorable discharge<~~~~don't want that, going to be nearly impossible to find a good job plus being in a recession as it is that probably wasn't the smartest thing for him to do! Just think, he basically is abidded(sp?) to a contract, so if you had someone under contract and they breached it what would you think, ya know? Your boy f**k*d up!

    yea I know and what sucks is that hes not taking this very serious. He thinks hes going to get a slap on the wrist. I just think it would be better if he would plead insanity or something..

    If I was him I would. Pretty easy to fake PTSD or something.
    Just look up the symptoms online.
    He'll prolly get his arse kicked when he goes back.

    DP is right, they also do a great job detailing cars for cheap.

    In regard to your cousin, tell him to quit being a fuck up, check back in, and make something positive out of this.. Best to deal with the issue straight on like a man. If this has to do with him smokin' weed, he needs to stop until he's free and clear from the military and go meet his obligations. In addition to the negatives brought up before, he's also throwing away the use of the GI bill and $$ for college. He's definitely not thinking clearly.

    never been awol wanted too a few times, your boy needs to show back up apologize for his mistake square away his punishment and finish his commitment. There is no other answer and this is from a army made hippie thought: maybe have him contact his original recruiter maybe he can help out? Good luck and tell him to get back so we can thank him for his service! peace

    The offense of Desertion, under Article 85, carries a much greater punishment, than the offense of AWOL, under Article 86. Many people believe that if one is absent without authority for greater than 30 days, the offense changes from AWOL to Desertion, but that's not quite true.

    The primary difference between the two offenses is "intent to remain away permanently." If one intends to return to "military control," one is guilty of "AWOL," under Article 86, not Desertion, under Article 85, even if they were away for ten years. The confusion derives from the fact that, if a member is absent without authority for longer than 30 days, the government (court-martial) is allowed to assume there was no intent to return. Therefore, the burden of proof that the accused intended to someday return to "military control" lies with the defense.

    A person who is absent for just a day or two, then apprehended, could still be charged with the offense of Desertion, but the prosecution would have to show evidence that the accused intended to remain away permanently.

    Any person found guilty of desertion or attempt to desert shall be punished, if the offense is committed in time of war, by death or such other punishment as a court-martial may direct, but if the desertion or attempt to desert occurs at any other time, by such punishment, other than death, as a court-martial may direct.ā?

    And unfortunately, this is technically a time of war.

    Despite my Navy Chief approach earlier in the thread.. it would really be in your cousin's best interest to return. I liked the idea earlier of checking in with a local recruiting office. No matter, what your cousin has done, he'd be viewed much more favorably for taking his own steps to return.

    Thanks everyone !!

    You know i have tried to talk to him and he just doesnt want to hear it. He wont talk about his experiance or anything. hes a pussy i told him from the get go not to go in. But since our other cousin was in and he looks up to him he just had to. Maybe this will teach him to think before he acts...

    I will try talking to him again.... wish me luck..
