Hey so basicly i got my bong taken by the RA at my school and i want it back cause i just bought it. Here is the sorry. If anyone cant find a violation i can get by bong back.

I go to a public university and live on campus.
its midnight and me n my room mate are hungry so we decide to make breakfast. i go into the kitchen and place a pan on the stove and turn the stove on. I go into another room to get bacon, eggs, and other breakfast shit and the empty pan some how sets the fire alarm off. I take the pan off the stove and walk into my room. me and my room mates wait the 10 minutes for the cops to arrive. I am in my bathroom when he arrives and no one answers the door so the cop lets himself into our house. He goes around trying to find people and cant find anyone. So the cop some how stumbles into my room while im washing my hands and when i hear someone in my room i go check who it is and hes just looking at my bong.

He asks me if the blazing set the fire alarm off and i say "no a empty pan set the alarm off in the kitchen." the cop says "well im gona take this with me" and so he grabs the bong and i grab my medical card to try and save my bong. He asks me if there is any weed in my house and i say no because i had just smoked the last of it that day. so the officer begins asking my roommates if they have anything and they answer no. the entire time hes acting like a dick saying hes gona get a drug dog to search our house. I find out that the cop really hates weed and he thinks for some reason that im going to attack him so his hand is on his gun the entire time.

Anyway so the RA finaly comes and he says that he gets to take the bong. So I show him the card and he says "to bad" and walks out.

So sometime this week i will have to talk to the school about it and im wondering if anyone knows how to sucker the school into giving me my investment back. They will try to kick me off campus but they cant because I am a good kid and havnt caused any trouble.

The school has a policy agianst paraphanalia but im thinking if i pull a medical situation i might be able to get it back. Anyone else go through something similar? and what happened?

Was the bong dirty?

Was there weed in the house?

Because if it was clean and there wasn't any weed you could have surely told him that he cannot simply come into your room and start searching, since he wasn't invited in and he wasn't given permission. There's another thread here I read that was really good on making quite clear what your rights are when it comes to police encounters.

You shouldn't have admitted to having smoked anything, mate. I hope things work out for you though, read up on that other thread and see what the people here say(since they are American and will know your law better than a Scotsman does :P)

ok i have an update. There was NO weed in the house. and yes the bong was dirty. Apparently cops are allowed to just walk into my house since i live on campus. I had a meeting with a RLC at my school and she said since the school if funded by the federal government they must obey their drug rules.

I am argueing saything that with the new administration state laws and local laws hold priority over the federal law. AND since it is a California STATE university it is considerered a school of CALIFORNIA and not the federal government.

The school says that paraphanillia is illegal so they are allowed to take it.
