In my daily work (servicing copy machines) I spend quite a bit of time in customers offices in 5 counties. These offices include a number of local PD's and County Sheriff's offices. I have on several occasions heard comment regarding MMJ. I was suprised to discover that each agency views the law differently. Some common items I have heard bother me a bit though:

1) Many of them don't view MMJ as legit medicine but as a way for hoodlums to get away with something that they shouldn't be doing.

2) Several agencies are looking for ways to force local registration so that they know where all MMJ activity takes place.

3) Many MMJ recomendations are considered to be "questionable" simply because the paperwork/form from the physician is sloppy or unprofessional looking. Apparently the purdy colored letterhead makes the recommendation "more legal".....

4) It gets worse. I have heard comment that a particular MMJ recommendation was probably phony because the picture of the recommending physician that they found on the net "looked like a stoner"...

If your local law enforcement does not agree with the validity of your MMJ recommendation they can still arrest you and try and make you prove it to the Judge. A legit recommendation should not be difficult to back up in court but the time, money and hassle involved could be quite significant.

IMHO: There are two things that may help:

1) Send copies of the "King County Memorandum", that another member kindly provided, to your local Police Chief or Sheriff. Please make lots of copies as I need the work

2) Impress on the Physicians and Support Organizations that presenting a professional image to the general public and to law enforcement is critical.

The cops I meet tend to be the same as the public to a certain extent. A wide range of viewpoints on MMJ. The problem of course is police are in a position to persecute anyone they think is a crook.
I think you should get the fax numbers of every copier you work on and we''ll all start faxing correct info to them so they can make an educated decision.lol

I think that these things that you ask for will not help one bit.
Here is why.

The feds got together and decided that they did not want to interfere with State mmj laws because it would be viewed as outside interference and going against the will of the people.They thought about amending 903 of the federal CSA but were advised against it.They chose to condition federal granst on states enforcing a federal drug control policy.

The County drug task forces have signed what is called a statement of assurances to enforce a federal drug control policy.The WSP,LT Governor Governor ,and all the drug task forces have signed them.The WSP has entered into a regional drug task force agreement which puts the DEA in charge of the drug task forces.In effect our state drug task forces have been commandeered by the feds with federal JAG grants and interlocal,interagency,HIDTA GRANTS,AND REGIONAL AGREEMENTS.

This notion that we should make things easier for counties,when the county charter authority rulings clearly say that county laws are subordinate to state general laws in matters beyond local concern and have to follow state general laws,and not create special county versions..is Poppycock

It is the federal preemption grants that give the counties what they feel is a right to enforce federal law.That is why trying to make things more clear for the counties that have all signed federal grants to enforce a federal drug control policy would not work.

The MMJ WAC created in November is all the counties need,and a copy of the County charter authority,which clearly states that county laws are subordinate to state general laws.

If a prosecutor wants to extort you for a state plea in the threat of going federal,now there will be a Democratically appointed US Attorney that won't take a case less than One hundred plant I am guessing.

Thousands of dollars worth of Public disclosure requests can back this up.Sarich even knows this to be true.

TACOMA REGIONAL TASK FORCE AGREEMENT
FY 2005
This agreement is made this 30th day of September 2004, between
the United States Department of Justice, Drug Enforcement Administration (hereinafter "DEA"), and the Washington State Patrol (hereinafter "WSP").
Whereas there is evidence that trafficking in narcotics and dangerous drugs exists in the Pierce County, Washington area and that such illegal activity has a substantial and detrimental effect on the health and general welfare of the people of Pierce County, Washington, the parties hereto agree to the following:
1. The Tacoma Regional Task Force will perform the activities and duties described below:
a.
Disrupt the illicit drug traffic in the Pierce County, Washington area by immobilizing targeted violators and trafficking organizations;
b.
Gather and report intelligence data relating to trafficking in narcotics and dangerous drugs; and
c.
Conduct undercover operations where appropriate and engage in other traditional methods of investigation in order that the Task Force's activities will result in effective prosecution before the courts of the United States and the State of Washington.
2.
To accomplish the objectives of the Tacoma Regional Task Force, the WSP agrees to detail one (1) experienced officer to the Tacoma Regional Task Force for a period of not less than two (2) years. During this period of assignment I the WSP Officer will be under the direct supervision and control of DEA supervisory personnel assigned to the Task Force.
3.
The WSP Officer assigned to the Task Force shall adhere to all DEA policies and procedures. Failure to adhere to DEA policies and procedures shall be grounds for dismissal from the Task Force.[/B]4.
The WSP Officer assigned to the Task Force shall be deputized as a Task Force Officer of DEA pursuant to 21, U.S.C. 878.

PROJECT MANAGER'S REPORT:
Rac Gordon informed the board that during the month of January there was a case wherein we buylbusted 5 defendants for distributing Meth. We seized 4 cars, 2 guns and arrested 5 They were stashing their dope in the rear speakers of a vehicle.
The group also assisted WESTNET with the· search warrants on several medical marijuana operations. The net plant seizure was 1193 plants, arrest of 5 people who tended the grows two of who were~whogave good implicating statements. It is believed that the targets of the investigation 3 and are working with ~::::~~~~~~:=~::::==;
.......The Department of Defense is looking is the director of _ a facility who sells plants to patients so that they can have their own grow and supply. Federal Law does not recognize Medical Marijuana consequently if our office goes out and does a raid and finds marijuana there the plants will be seized even thought they maybe under the medical marijuana threshold. The office also has done several grows in the city of Tacoma. These seem to be run

Certainly not from you, and any federal money used to enforce medical marijuana in states that have mmj laws would and should now be considered a misappropriation of funds and should be returned to the federal government since they no longer support medical marijuana drug policy enforcement in those states. :thumbsup:

And I see you are continuing your domestic terrorism policy against legal Washington State Medical Patients. Don't threaten me in an overt way, I can't or couldn't have been more transparent, and if the knock should come, the door is open. Give us your name and address so we can exercise our First Amendment Rights, and organize medical patients to come ans show their support of your support of Washington State Medical Marijuana Laws.
