??We??re doing this without fanfare,? said Len Foster, county director of health. ??It??s not something that, from the public health perspective, we want to promote but are required to do it by state law.?

The identification cards are actually issued by the state Department of Health under a 2003 law drafted to clarify voter-approved Proposition 215. The card identifies patients who have received a doctor??s recommendation to use pot to ease their ailments, but it does not protect them from federal prosecution.

I asked my doctor if he had received any requests to approve medical marijuana. He said that he had received a dozen or so requests, most of which obviously were of merit (e.g., a patient with a closed head injury). However, because of the possibility of the loss of his license (and thus his livelihood), he was not going to approve any requests. Understandable, especially since the DEA has lately begun to target doctors and patients, while claiming that they are not. So it goes.

In 1997, Conant v. McCaffrey, a class-action lawsuit, was filed on behalf of physicians and seriously ill patients against Drug Czar General Barry McCaffrey and other top federal officials who threatened to revoke prescription licenses or criminally prosecute physicians who recommend medical marijuana. In 2002, a three-judge panel of the Ninth Circuit Court of Appeals unanimously decided to uphold the right of doctors to recommend marijuana to their patients and of patients to receive that recommendation. Judge Mary Schroeder wrote the majority opinion, which noted that the federal government??s policy of revoking doctors' licenses ??leaves?no security for free discussion.? A concurring opinion by Judge Alex Kozinski stepped even further, noting the prevailing evidence on the medical usefulness of marijuana.

don't waste your money on 'the card', it is NOT required by Law, and just puts you on their 'List' ... it's something a few Counties jumped on the 'let's make a few bucks' wagon with ... :smokin:

Personally I agree with the image reaper. If you can buy it without a card, do it. Nothing is legal, it is all a defense after you're busted. It is a deterrent to getting busted. It quasi legitimizes it to those without a clue as to what it's all about. But in several places the politikops, cops, district attorney's and politicians have been so low during Club busts as to take the list of patients, even before the Ganja. Straight for the computers. Then potentially an easy bust on off days just letting their fingers do the walking. Low life anti American immoral unethical but still done. Then there are the fascists at the DMV.

    Patient's License Revoked by DMV

And depending on where you work, if they find out you have a card they may choose to taste your piss for drugs and then fire you without any recourse since Arno the Toad won't intervene and enforce prop 215 at the workplace.

Painkillers Are OK At Work - But Not Marijuana?

If you're a senior or infirmed or in a position where street pot is hard to get, or dangerous or a chance of being ripped off. Buyers clubs do have medicinal quality, pretty expensive, but quasi-legit pot. No experience or connections can get more trouble on the streets, especially in conservatude Monterey. I've never had a problem with cops doing hospice work in Santa Cruz, never ask me for a card or for the patient. I take the full responsibility for my patients and their doctors so I don't require a card or anything that would jeopardize the doctor. But someday I hope it will be a service for all and no ill willed politikops or drug Biz Czars busting sick people. I've used Ganja as a preventive and haven't had a cold since 1969. Good luck...
