Actually, this new requirement has already been in effect (as of 8/25/08).
What was supposed to go into effect 11/01/08 was the regulation regarding mandatory observed collections for all follow-up/return to duty DOT tests.

However, yesterday, 10/31/08, The U.S. Court of Appeal for the D.C. Circuit has temporarily delayed the November 1st Direct Observation requirement for DOT return-to-duty and follow-up tests. The Court has issued what is called an administrative stay until The Court completes its review on the matter. Therefore, direct observation for follow-up/return to duty will continue to be an employer option, rather than mandatory at this time. The DOT will keep the public informed when the Court makes a decision on the matter.
