    Finding a reliable doc - who will stand by you in court?

    Hi all,
    I've read so much on docs in So. Cal who will write you a rec with little to no proof/documentation of your existing health condition, which many people get excited about, not realizing that if they're ever in serious trouble with the law they could be left holding a worthless piece of paper with no physician back-up.

    How does one go about finding a doctor who will write a recommendation - and who will stand by his/her patients in court? I've heard conflicting stories about MediCann (for example) standing up with their patients, and equal stories of them not offering assistance of any kind in court. It seems perplexing, and honestly, scary. I have no interest in a recommendation if it won't hold up in court. I of course know one's own medical paper trail will assist in a legal bind, but having your doc's office who wrote the rec assist with the process is vital.

    I have medicann and I assumed they would since they are a huge collective of doctors now but I guess it differs from doctor to doctor?:wtf:

    Looking at it from the Drs point of view.....why should he/she risk years of medical training etc so that you can smoke dope when you want? The doctor I went to offered to stand by me (she's now in JAIL btw) and gave me a paper saying court time cost US approximately $1000/day for her to testify but also that she WOULD testify for us if it came to that (as long as we paid of course).

    Yes those doctors are out there........but you'd better have a pretty big wallet.

    Yes it is. There are two sides to the story (of course.....) but she said she was giving clones to patients and the prosecution said she was selling. At the time the hubby and I went to see her ALL this information was given to both of us before we saw the doctor......the fact that they had been found guilty of several things. One charge was listed that they had over 100 plants growing. The trick of this is that it only added up to 100 plants over a period of about 3 busts.....approx 30 plants each time. The prosecution was allowed to go ahead and charge with the 100 plant charge and that is what made things a felony with mandatory jail time.

    reminds me of the court process in Chicago 8... all that drama was overturned within years.

    I'm thought the appeals process is still ongoing?!?!?!

    she was sentenced to 5 years in prison early march 2008, by end of march she was released on bail pending appeals

    Can we get back on topic please? How can we, as patients, be assured our rec will keep us free from prosecution?

    There have been stories of patients who have received recs from "recommendation mills" only to be left high (no pun intended) and dry without legal support or backup from the doctor who prescribed the recommendation - meaning essentially, a worthless piece of paper and possible incrimination / incarceration. Serious problems. There doesn't seem to exist a "post-police review system" of recommendations to be able to guage the effectiveness of a doc's recommendation and its ability to hold up in court.

    Actually i listed the point already. You ready to pay for that guarantee? Then start calling around and asking the 215 docs. If you want to be DAMN sure.....go get info yourself and don't ask strangers on an internet cannabis forum. :wtf:

    Flying......yes, they appealed but lost....and are now in jail for the five year minimum sentence.

    my Doctor said he would testify, if necessary, as to the reasons I qualify, and need, Medical Marijuana ... fortunately, I haven't had to put him to the test ... a friend ignored my recommendations, and went to a 'pot permit wholesaler' (a money-hungry 'Dr.' that basically sells recommendations) ... I've warned him, that the local and County cops pretty much know which Doctors' recommendations to respect, and which are likely to be bogus, but he paid no heed ... yes, if a cop thinks your recommendation may be unwarranted, he's likely to bust you, and let the Judge decide ... after all, what's he got to lose ? ... :smokin:
