I would not even risk taking a sample.

Lets say you ran into a commercial growers plot, and see this field of the most beautiful plants and your first instinct is to go check them out. At about 10 feet away you step on what you think is a pile of leaves and bam someone set a bear trap and takes your foot off.

Look I have heard of many different and insane ways that commercial growers use to protect their crops and it is not worth the risk.

Now lets say you ran into a small plot that is obviously for personal. It was not well hidden to begin with if you found it, and may already be known by the law. Then they are waiting for the grower to show up. Then you show up and take a sample. I don't think they are going to believe it is not yours.
