Prospective employers can pretty much do what they want as precursors for pre-employment testing. The *ONLY* sure way to pass is don't smoke.

FWIW, these days its very common for employers to conduct pre-employment criminal background checks, financial histories/credit histories, drug testing of their choosing, and even check medical histories. Now a lot of companies will not hire tobacco users either. There are some that even specify certain physical attributes...grossly overweight etc., will disqualify you for certain jobs.

The only thing they can't ask you anymore is your ancestry/race.
