    DEJ, Background Checks, and MMJ.

    Hello. I am new to the forum and I have a few questions I'd like to have answered.

    First, I am currently under a DEJ program with the court for a drug related offense a few years back. As it stands, I am about 3 months away from completeing my probation period for the program.

    Now, my first question is: can a judge see any changes made to my personal record upon my return to court? In other words, if I were to obtain a MMJ card, would this pose any problems for me once I return to court?

    Now onto my second question. Is the issuing of an MMJ card covered by the doctor/patient confidentiality stipulation? For example, were I to apply for a job with a company, could my prospective employer find out that I possess an MMJ license?

    All that is necessary is the doctor's recommendation. It can even be oral (but getting it in writing is the normal course of action). I don't have a card- I don't trust our local gov enough to get one. It is SUPPOSED confidential, but....

    Yes, short of a court order to get the doctor's records, you are covered by confidentiality. Ain't nobody's business but your own!

    I wouldnt be worried that a judge would find out about a recomendation, but take into consideration that you may be drug tested at the end of your probation period depending on the seriousness of you drug offense.

    Well, the type of probabion program I am enrolled is quite lenient due to the fact that it was my first offense. I have not been drug tested since I began the program, and I was never formally assigned a PO.

    However, they could toss that curve ball at me during the final court visit.
