Judge orders Police to give back Marijuana
A California appeals court has ordered the police in Garden Grove to return marijuana that was seized from a man during a routine traffic stop.
The man, Felix Kha, had a doctor's prescription for the marijuana, which he used for the medical treatment of chronic pain. The judge ruled that enforcement of federal drug laws did not supersede the state's allowance of marijuana for medicinal purposes.
The three-judge panel from the state's Fourth District Court of Appeals cited constitutional principles of federalism and power-sharing between state and national governments in ordering the marijuana returned. California law allows for the prescription and possession of medical marijuana in amounts of less than eight ounces.
Police officers pulled over Mr. Kha in Garden Grove, south of Los Angeles, in 2005 for running a stop sign. When they asked him if he was in possession of any illegal substances, Mr. Kha said he had marijuana. Officers seized the marijuana, about a quarter of an ounce, and cited Mr. Kha for possession of marijuana and a traffic violation.
Mr. Kha pleaded guilty to running the stop sign and asked the judge for the return of his marijuana. After hearing proof of the authenticity of the doctor's note, he was given permission to retrieve the marijuana from the police department.

now, THAT is really good news ... if it had been the lamebrains in the SF 7th appeals court, it would have been no surprise ... but, L.A. way, that is real good to hear, when the Judge says the cops have no call to enforce the Fed laws ... we need more gutsy judges like that ... (his career is probably toast, now) ... good post, P4B :thumbsup:

we have all these people in law enforcement in the state of California saying 'we don't know what todo" seems pretty
simple too me, you are paid by the state of California,not the federal government! follow your state laws! made by the people paying your salary! the citizens(taxpayers) of the state of california.

Its great to see even judges standing up against the oppresive feds. Anyone down there be sure to remember that when he comes up for re-election. Thats the kind of judges we need that follow state law.
