Forgive me if this has been discussed. I searched and didn't find anything.

I'm trying to find out how the pretrial hearing went and all I could find was this: Marijuana Laws on Trial - NORML

While both Stroup and Cusick readily admit they were indeed sharing a marijuana cigarette at the time of their arrests, both have entered pleas of not guilty. Through their attorneys, they have filed a motion challenging the constitutionality of the statute criminalizing responsible adult marijuana smokers, and will shortly be filing a second motion requesting the trial judge to inform the jury of their right to return a not-guilty verdict if, in their view, the defendantsâ?? actions did not amount to criminal conduct. This long-held traditional power of a jury â?? to refuse to convict if its members agree that such a conviction would create an injustice â?? is fundamental to the juryâ??s role as the bulwark of American individual liberty.
