Isn't it a requirement or basically you agree to give consent at anytime in order to receive your license in most state now? Since driving is a privledge and not a right, you agree that you will consent to testing in order to receive your license and if you don't you are subject to suspension.

Remember probable cause doesn't equal warrantless search. You have to have probable cause and an exception to the warrant requirement to search the car without a warrant (plain view, consent, etc), search for possible weapons that would be in one's reach, or a inventory search if the car is towed following arrest.
