Question about probation urine test?

I recently got a DUI and have a court date coming up in mid february. My question is: If i choose probation does it matter if i fail my initial urine test? I have heard from friends that you can fail the first one as long as you show decreasing levels thereafter. Is this correct?

I think it depends how long from the dui your first ua is.

I was charged with Possession of Marijuana, and I kept smoking till the day of my court. Failed my DT but its not like they did anything they knew I smoked because I got caught with pot. DUI might be different, I wouldnâ??t fail the first DT the judge might go easier on you.

It's a bogus myth that the first drug test doesn't count, but whether you are violated depends upon the good nature of your probation officer and judge. I suppose it also depends upon how honest someone was when they "checked-in" to probation. Think about it, someone who was upfront about prior drug use might be treated differently than someone who lied about never doing drugs in their life and then pissing dirty a few months afterwards. Someone might not necessarily get violated for testing positive on the first test, but be ordered to treament/counseling which only adds to the financial raping people go through on DUIs.
