Mom gets up to 10 years for swinging baby

The 28-year-old mother of five convicted of swinging her infant son like a baseball bat was sentenced today to five to 10 years in a state prison and two years of probation.

ā??I miss my kids,ā? Chytoria Graham said through sobs before she received the sentence from Erie County Judge William R. Cunningham.

Graham was found guilty of breaking the skull of her then 4-week-old son, Jarron Troop, during a fight with her boyfriend, who is Jarronā??s father, at her Erie apartment in October 2006. Jarron has since recovered.

A jury convicted Graham Oct. 10 of aggravated assault and other charges. The aggravated assault conviction carried a five-year mandatory minimum sentence due to Jarronā??s age.

Graham pleaded guilty in March. She withdrew her plea in June and went to trial.

During that trial, Graham told the judge and jury repeatedly that she didnā??t remember what happened the night she was accused of swining her son.

ā??You know what occurred that night,ā? Cunningham said during this morningā??s sentencing. ā??You are in denial because you have been in denial for all of this case.ā?
