If your buddy got pulled over for DUI then why did they search you? Did you let them? If so it is your fault you got busted. If they asked you can we search you and you said yes, you gave up your rights. If not and they searched you anyway then that search was illeagel. They have to have a reason to search you. The only leagal reason I can see for them too search you is if they smelled it, then they have the right.

Well, here in TN all cops have the right to give ANY person a "terri" search, or search for weapons for the officer's safty. I had the bud in a jar, and according to the lawer I talked to if they feel a medium to large, solid object in a pocket they can make sure it is not a weapon by having you pull it out, or in my case pulling it out themselves after I assure them it's not a weapon. Never the less, the cop that pulled us over was a K9 unit, so if they wanted to bust me they would have anyway. I know my rights, but police have getting around them down to a science. They have bi-laws for just about every right you have.
