So sorry about this, Ceecee. Hell yes, the landlord should kick the shooter the heck out, and if he/she doesn't, you need to get a copy of that police report once it's done and write a very firmly worded letter accompanying a photocopy of it assuring your landlord that you'll engage the services of an attorney to get out of your lease if you need to to protect the safety of your fiancée and child (a threat here should suffice; you won't really need to hire a lawyer unless you have the most disreputable landlord in the world). Most standard lease contracts have clauses about illegal activity and sections empowering the landlord to terminate the lease, with illegal cause, at will or possibly with a defined notice period. If you can find the lease you signed and find that clause in your paperwork, you'll know it exists. That's not only for the protection of the landlord but also the protection of good tenants like you and your family.
Don't count on Mr. Bang Bang Domestic Violence being outta there or kept at a future distance defined by a restraining order. I've volunteered for nearly 20 years in a crisis center that deals with domestic abuse, and if there's one thing a large percentage of those ladies do, it's take abusive losers back into their lives with alarming speed, particularly if they're scared not to. You might consider finding out the address and location of the nearest women's shelter in your area and providing that to your neighbor anonymously. Also, if you live in a medium to large city, your police department will have someone on staff with a title like "victim's advocate," who is basically an officer or social worker who can assist the young lady who's your neighbor and help her access the protective services she needs. She didn't break the law, so there's no solid justification to evict her from the property next door. This is not good news because, of course, if he's got her in his targets, as long as she's still there, others around that apartment are still vulnerable to any more offenses he may commit.
I hope to heck he has a long criminal record and is being held someplace without bail, but that's unlikely. Chances are far greater that he has a long record as a domestic abuser and has never once been charged or held accountable for anything. That's the way that works in most of those situations.
