Arrested for "being" high?

I am wondering what the laws are for just "being" high. Like if you smoked a joint and had no finished roach on you, could a cop arrest you if he smelt weed?

Hell no. At least not in South Africa. I've never heard of case like that and have heard of lots of people facing cops stoned right after throwing there pipe aside.

Nor here is the UK is being high a crime and you cannot be arrested for being "stoned", I think the only time it would happen if it was a minor obviously high as a kite but still no charges could be brought if the subject wasn't doing anything else (e.g criminal damage etc). It's most things that go with it, like possession of the substance.

In America if you are under the influence of any drug or alcohol in public you can legally be arrested.

Yeah thats one of those chickenshit little laws.Under the influence of any substance and the officer at his discretion has the right to ticket you.I think most cops don't bother though unless you're being an ass.

Exactly killerweed, don't try and instigate the situation like some do and think they can get away with it.
A couple weeks ago I was at the gas station and bought a shitload of munchies for me and two other people. Right when the cashier is bagging my stuff a cop looks over from the register beside me and says "Munchie food huh?" I kind of laughed it off and as I walked away he said good bye.

shamp that shit happens to me all of the time. it freaks the hell out of my friends though, theyre like dude its a cop we gotta go now, and im like we dont have anything on us he cant do shit, then ill start talking to the cop asking him questions and stuff and my friends get scared and leave, its hilarious.

Thats because they ticket people for cussing in VA Beach, not because of the weed thing, but because you said shit. And they really can't arrest you in America for being high. There's no way to prove it if you don't have anything in your possession. Thats why there no weed dui's reported ever because it is so rare of a thing that can't be proven and will never hold up in court. All a drug test proves is that you've smoked, but it doesn't prove when you've smoked.
