    Drug testing is really getting ridiculous in this country

    Its their perogative as an employer. As long as the gov. offers no incentives I have no problem with private employers testing. Though I do think its fucked up...
    I see a red door and I want it painted black / No colors anymore I want them to turn black / I see the girls walk by dressed in their summer clothes / I have to turn my head until my darkness goes

    I gotta disagree with you on this one.

    This is scary shit, and I'm grateful everyday that I don't live in the US. So much for your liberty and freedom. It should NOT be an employer's right to test people for nicotine. I'm willing to accept that some companies might test for weed, which is illegal, but tobacco is completely legal and there is no reason to do this nazi shit.

    What's next? They won't hire gays just because? They won't hire anyone with hair too long or too short? They won't hire anyone who's not 25 and good-looking? (After all, company image is important, right?)

    Heh, I heard today the Kim Jong Il over in North Korea has declared it illegal for men to have hair longer than 5 cm (or about 2 in.). Wow, it seems America and North Korea aren't so different after all...

    Like I said, I can understand testing for weed, since it's illegal and can affect your performance, and by the same token, I can understand testing for alcohol. I just find that testing for nicotine is stupidly excessive and should be banned.

    Speaking of grug testing just recently where im from (Australia) theyr thinking about doing saliva tests for drivers to determine whether theyr under the influence of weed and amphetamines. Saliva tests pick up drugs that were used from up to 4-5 days b4. Thats either a lot of ppl giving up weed or a lot of ppl walking...

    I think drug testing is justified for a job that has responsibilities for peoples lives. ie; pilot, driver, chainsaw operator, etc. But even then it should be limited to testing if they're working high, not getting high on thier own time....

    Every time we sacrifice a right, and excuse for one reason or another, we are LOSING OUR FREEDOM. It's our responsibility as citizens (or in my case, temporary citizen) of the US to do something when our rights are challenged.

    This is a violation of the unlawful search and seizure amendment. It is outside an organizations legal boundaries to search a person's INTERNAL body for substance use outside their property lines (and technically within them. In most cases, a search of one's internal body -i.e. drug use, disease, etc.- for any reason needs a warrant). Basically: you do something off their property, they can't touch you. The police can, but they have to catch it, or find proof.

    Losing your job because you use a LEGAL substance on PUBLIC property (or god forbid your won) is completely illegal. And if it's not, it's clearly MORALLY illegal.

    the justification these companies are using is that they want to cut down on the health costs, and by eliminating smokers (who have a greater chance of developing health problems) they eliminate many of the risks associated... this is total bullshit. like flesh said, what next? not hiring gays because they tend to have a greater risk for stds (unprotected sex more common since there's no fear of getting your boyfriend pregnant)? not hiring someone who at one time or another had pneumonia because they're at greater risk for a relapse? not hiring women because they have a greater chance of developing breast cancer? not hiring men because they have a greater chance of developing prostate cancer? not hiring people because they can die? it seems that this statement is becoming so cliche, but this is yet another example of how little freedom we really have (i wonder why it's becoming so cliche to say that...)
