    Just got busted for passing a joint

    I was half drunk, dry (weedwise) looking to score a bag at fair in Maine. I ended up getting passed a roach from a guy sitting in a truck, I passed it to a minor who said no because he was high.

    Undercover cops saw the whole thing. Doh!

    I got charged with "attempted aggravated furnishing of a class "Z" drug."

    On the NORML website it just lists possession, cultivation, and sale. I wish they listed furnishing. Weed is decriminalized in Maine. You can have one OUNCE on you and it is a "civil violation," not even a misdemeanor. (I contacted NORML and asked them to add furnishing to their website.)

    With that in mind, I think it's ridiculous that I got charged with a misdemeanor for passing a joint.

    The cop said if the minor took a hit, it would've been a felony.

    Also, I did not get arrested. They did not read me my rights, they just gave me a summons.

    Does that mean anything I said can be used against me in a court of law?

    Hopefully the possession law makes me not guilty of furnishing since it was less than 1 1/4 oz of weed in the marijuana cigarette. That is what it looks like.

    I am getting a NORML lawyer if I can.

    Just wanted to mainly make people aware of the furnishing (passing a joint) law. I don't know what other states have them.

    so wtf were you doing smoking up in and around a motor vehicle?? and being "half drunk" too?? They could have packed it in your ass for that....

    A little common sense goes a long way....and saying that common sense goes out the window when your stoned doesn't wash either.

    What you do in the privacy of your own home is nobodys business but your own. As soon as you go out in public, your subject to scruteny.

    Don't put yourself in a position where somebody has to do something about it.

    Well dad, thanks for the scolding. Of course, what I did was stupid. The point of this post is to inform people of the furnish law.

    No offense, but you deserved to be scolded. That was not smart of you, but thank you for the warning. I hope you've learned something from all of this. Trust me, we feel for you (your father and I :thumbsup: ), but you've got to realize that was bad judgement anyway.

    By the way, chances are you'll just get a ticket, especially if there was no prison time. I wouldn't worry too much, I"m not sure if you'll need a lawyer but it may be a good idea to talk to one quickly. Also, dress very well for the summons, don't wear casual clothes =D

    I won't scold you. It's obviously not necessary when you've long since taken care of that yourself. Not sure why others feel the need to do that, either.

    You don't have to be read your Miranda rights unless you're being held, either arrested or just held "custodially," so you can be asked questions relating to the commission of a crime. You weren't arrested, held, or questioned. Just summoned to a court date because of the charge you received, so you didn't have to be Mirandized. It's a common misconception that everyone under all circumstances of arrest or detention must be Mirandized in the United States. Miranda rights have to do with questioning about a crime.

    I suppose that anything you said could be used against you in court, but it's unlikely. Of course, I don't know what you said or admitted to. But what'll be used against you in this court proceeding is what the undercover cops witnessed.

    dude i live up in maine what fair were you at? anyways i was in school and got busted for having like .4 i begged the woman to just fucking throw it out but she was a fucking bitch and brought in the toughest cop they had to be all fucking mean to me and shit, it really fucking sucked i couldnt smoke for like 3 months.
    today me and my friends were smokin a blunt, so there was lots of smoke, out in a feild and all of a sudden theres a big suv driving straight towards us, i had the blunt and i stamped it out with my fingers, (cuz theres this guy who normally maintains the feild and whever he's seen us hes come but we ran) so i figured it was the fucker trying to bust us... turns out it was some woman just like setiing up a picknick but for sokme fucking reason drive right by us. and nobody EVER drives on that feild or even has picknicks at it. but yeah my friend was all pissy that i stamped the blunt out but it was just a tinny roach anyways, and between me and all of you guys the blunt was a huge dissapointment, it was pulling way too tight and all the smoke was pretty much coming off the end. i wish i had rolled it lol.

    yeah i got busted at a college party once by a undercover and all i had on me was a joint i was soo pissed...but its all good, good luck with the preceedings

    dude at the fair here [in south dakota] there are about 50 plain cops... it sucks, but this year we still got away with smoking on the farris wheel :jointsmile:

    Yeah. I think they did not read us our Miranda rights because they wanted to question us.

    On another important note:

    One kid drove the drug dealer (his friend.) Anyway, one of the cops said, "Did you know he had the pot on him when you drove him here?"

    "Uhh..."

    "Just tell us, we're going to find out anyway."

    "Yeah."

    Then that kid got charge with "transporting...." He should've just lied.

    I thought about putting a disclaimer about how I knew it was stupid so I wouldn't get fingerwagging from all the e-daddies, but I just wanted to state facts.

    The fair was in Union. There were a shitload of undercovers there.
