Well it was bound to happen one of these days. Looks like I got caught smokin pot by the authorities before my parents even caught me. Anyway, here's the story...

Me and my friends decide we want to watch 300 so we go rent it and head back to smoke at our usual spot. My friend that was meeting up with us said that he saw a cop at our spot like a week ago or whatever so we went to this parking lot he knew and parked in the back for a few minutes to smoke. We're done smoking in my car and just waiting for my friends to finish their joint when 2 officers come running out of my peripherals with their flashlights all over the place. I quick stuffed my piece in its case and put it under my seat hoping that they wouldn't search my car. Meanwhile, my friend that we met was getting shit from his trunk but he saw the officers coming and jumped in his car. He turned the fucking car on and just drove off (keep in mind this kid has a QP, scale, joints in a small case, and a suspended license). The 2nd cop jumped into my friends window as he drove off and was threatening to pull out his firearm but ended up just macing my friend while he was driving and the cop was half way stuck in the window.

They asked everyone to get out of the car and on the ground so i rolled up my windows, locked my car and laid down on the ground. They start questioning us individually and one officers attempts to search my car multiple times but I told him every time he asked "I do not consent to any unwarranted searches sir." So he threatened to call the dogs and i told him that he would have to because i wasn't going to let him in my car. When the dogs showed up I told them exactly what was in the vehicle and where. They searched my car and found my friends bag of weed along with my recently used glass pipe. I claimed the pipe and my friend claimed the bag. They asked me some more questions in the patrol car and then i had my brother come get me and take me to my friends house along with my possession of marijuana ticket.

My buddy got charged with possession of a 1/4 oz and my other friend got arrested and they found all of his shit including his scale and QP so he's still in jail and is probably fucked.

This morning I went home and talked to my parents about it and they've actually taken it really well i think. I'll be heading off to college at michigan state university soon so its not like they can ground me for more than a month. I guess I'm not grounded and all but they're really disappointed and I'm definitely not gonna touch marijuana for a while. Maybe if I get my own place.

My question is, what usually happens to first time possession offenders? I hope i dont go on probation or anything but if I have to, I'll accept that.

And its usually better to keep the piece on you.. they can find a way to search your car but they can only frisk you if they suspect you have a weapon.

I am assuming you live in Michigan. Possession of under an ounce can get you up to 90 days in jail and 100$ fine. It is a misdemeanor. This is from NORML. I would be incredibly surprised if you went to jail. If you do it will be for a day or two but I don't think you will go unless you have priors. Do you have any priors? If you did go to jail it would likely be for a day or two. You will probably have to pay the fine and may get probation. Keep us updated and good luck man.

gosh that sucks..my friends got caught smoking in the park, got searched...they found on one guy 18g's in a bag and 7g's in another plus a scale. Hell, theyre so stupid they didnt even know what the scale actually was and just handed it back to him, and he got a 60 bucks fine and a call to parents. God I love Quebec.

wutup i got caught up at my school selling bud (got caught with 4 grams bagged up) the school charged me with distribution and expelled me but an officer who came to the school wrote me a ticket and only charged me with possession. I went to court 1 month later and received 6 months probation. (no smoking bud, no drinking, no talking back to parents, and a curfew). You have to go to drug classes and pass 4 drug tests and report 2 in the middle of the probation and 2 more at the end, at least this is what i had to do. At the end of the probation you have to pay a 100 dollar fine. ON the first day u go to court though they will most likely give you 3 options. OPTION 1: take the ticket and pay for all of it (400 somethign dollars)and not be able to drive (if u have a license) for 6 months. if u dont have a license than you wont be able to get one for 6 months. OPTION 2: TAke probation and 1 month of no driving i think and 100 dollar fine OPTION 3: i think the last option was to fight it but i mean if you were caught with the bud than theres no real reason to, but than again it is TRAFFIC ticket so it might work the same in that to fight it it all depends if the cop shows up to court.

Thanks for all the advice so far. Also I'd like to note that I never consented to a search of my vehicle and that they simply brought the dog, detained me and searched my car while I was detained. Now that I look back I realize that I should have crotched the bowl but I didn't have enough time to think about that. I'll update you guys after I go to court this upcoming week.

That's alright my parents have saved enough money to pay for my 4 year education fortunately. Thanks for the info though.

I'll update soon after I speak with my lawyer again and analyze the police report.

You should try to get out of that. You need to get a lawyer, and he will advise you of what the exact law is in your state, but in NC, you have less than a half an oz and you just get a ticket. If you are a 1st time offender you can go to a "rehab" program which costs, of course, but there are no drug tests involved, and when it is completed, you don't have to go back to court, and it is not on your record.

Also I would like to add that it is complete BS that a marijuana conviction on your record will disqualify you for federal financial aid, while a felony conviction for rape or murder may not.
