I got arrested on June 29. I am 16 year old male living in the Midwest, and, although i havent been charged or convicted yet, in a couple months im gonna be going to court on a felony theft charge, as well as a few possible petty thefts.

If i get convicted of the felony, i probably wont get that bad of a penalty, but i will have a felony charge following me around for some time. I talked to my lawyer today and he was suggesting that we try to do some sort of diversion program, which could definitely include probation.

I have been smoking once a day for roughly a year or so, and im probably pretty fucked when it comes to the initial test. so i was wondering if they watch you for probation and whether i could substitute the initial test and be a real stand up guy and not get drug tested for the remainder of my probation, as long as i dont do anything to arouse suspicion that i am still smokin.

Also, i could have the option, although it isnt a weed charge, to cop to stealing shit for weed money (i wasnt, but it beats juvy) and just do IOP (Intensive out patient) rehab and do that. Only reason i wouldnt wanna do that is cuz i dont wanna sit through classes or some shit telling me how bad drugs are. I have the same question about this, would i be able to substitute rehab tests?

A freind of mine suggested that i go get a drug test at our doctors office or something (completely unsupervised) and substitute and test negative to show to the judge, is that a viable/useful option? (not a replacement for either of the above two options but just a show of good faith to the judge, as well as community service that im starting and good grades in school)

To be honest, if i cant sub the probation/rehab tests i will stop and do some minimal cleaning (just run, work out, and drink a lot of water and some niacin) because the initial test wont be for a couple months at least.
