It depends on the individual state. In some states it's as simple as fearing for your life or the life of another. In others you are required to equal or lesser force in order to defend yourself (I'm not 100% sure on this.) Many states require you to try and flee before you use deadly force, where as others, like my lovely state, allow you to kill fire preemptively as soon as someone enters your private property without permission.

Overall it depends on the state though.

Side note:
There was a case here a few years ago where a guy shot someone from his balcony who was breaking into his car. He was tired of his shit getting stolen in New Orleans, so he killed the next kid he saw doing it. I supported him, unfortunately he was convicted...
