It would be easy to prove. They would have dates for each activation, and I'm sure your ISP could help you prove your case. If it went to court and it was discovered they optained their information without a warrent, I can't imagine it progressing in most U.S. courts.

I'm not sure how phone taps work, but I imagine the legalities would be very similar.

I still think it's fucked up and they need to stay out of our lives. But I don't think it is as dangerous as everyone is afraid of.

You shouldn't start being frightened when the government has the ability to overlook internet activity, but rather when they have the governmental power to do so(and interest for that matter).

Between this, the PATRIOT Act, Military Commisions Act(and the fact that they even excercized the measures thereof before it was even passed[eg Jose Padilla]), NSA wiretappings... I've said it before and I'll say it again, welcome to the land of the free, people.
