what makes something drug paraphanelia. is a glass pipe paraphanelia because you buy those at stores and you can smoke anything in them. Is a bong paraphanelia because they are sold in stores and they can be used for tabocco or legal smoking herbs.

It depends on the situation.....If a store sells a pipe advertised as a marijuana pipe, then it is paraphernalia, if they sell it as a tobacco pipe it isn't. If you buy that pipe and use it for weed then it becomes paraphernalia.

Any item that can have a dual purpose needs additional evidence to warrant it being called paraphernalia, but any cop can be over zealous and make a judgment call right or wrong.

If you get your pipe taken from a piggy MAKE SURE YOU ABSOLUTELY contest it and have them test it first. If you're caught with a bag with your piece then you are usually fucked, but IF IT'S JUST A PIPE CONTEST IT! I had a DUI with a pipe on me and my lawyer helped me out :thumbsup:. Got out of both. It costs around a grand for them to actually test to see if it's an actual weed pipe so it doesn't happen often. And make sure you NEVER ADMIT GUILT.

Ha in wisconsin thoes little excuses dont work unless you wanna pay a lawyer instead of the police department. We got strick penalties up here and the cops are dicks.
