    I was arrested for a crime 11 years ago, that I did not committ. They arrested me almost a year later after the false accuser accused me. They arrested me two weeks before the next sherriff election. I was being railroaded in a small town in arkansas. I was looking at 10 to 15 years in the pen. I never got in trouble for anything. I wasnt even smoking weed back then, and I havent gotten in trouble for anything since I was accused. I smoke weed now, but I am very carefull. I have somone bring it to me, and I dont carry it in my car.
    I was young and ignorant of the law. I felt like I didnt stand a chance in hell of beating the charges, and I later found out that my lawyer had turned on me, by giving me false information, and he knew that the person who accused me had moved away, and they werent going to be in court. They offered me a plea bargain the same day that I was supposed to appear in court. They said that if I would just plead guilty to a misdemeanor assault that they would expunge my record after 5 years. They did expunge my record, but these background check websites still show my record of the felony that I was arrested for, and what I pleaded guilty to.
    When employers do a background check on me, the information comes up from these background check websites.
    I talked to another lawyer about what I can do about it. He said that we would sue them, but I would have to get these employers that I have applied to, to state on paper the reason why they would not hire me, but none of them will.
    So what can I do!? Im trying to find another job now, because I moved away from shithole Arkansas. I moved away because I got tired of people looking at me like im some kind of low life. I could look into their eyes and see what they were thinking when they would look back at me. "You were arrested, you must have been guilty of something." I wish that everyone could be arrested and railroaded for something that they didnt do, then everyone would realize that your not innocent until proven guilty. Your guilty, now prove to us that you are innocent.
    I have never sold any weed in my life, but here lately Ive been thinking about doing it. I dont want to end up homeless, just because I cant get a damn job.
    If you are ever arrested especially in a little town for something, dont ever get a lawyer from that same town, because they have the "good ol boy" thing going on. They lawyers hang out with the judges, judges and lawyers hang out with the cops etc. they have to because nobody else wants to be friends with the bastages!!

    You have to expunge it from your arrest record and court records separately. It's going to take hiring a lawyer again, but hey, get a better one next time, one that specializes in that type of case.

    Got a friend that paid 500.00 for a lawyer to esponge his record went thru all processes etc... now a yr later he still shows up on the O.T.I.S sites .

    I did, I hired a really good lawyer. He is a real good guy, we became good friends. He agrees that I was railroaded. He told me that I should have never taken that plea, but at the time the lawyer I had was the cheapest I could afford. The lawyer I have now is a criminal lawyer, he is experienced in this field, and he is a very intellegent man, he is not the kind of guy who will screw you over. I dont trust many people anymore, but this guy; I would trust him with my life.
    When he tried to expunge it from the courts, he found out that there was no record, so he contacted the National Crime Information Center. They have no record either. He sent Dac a letter stating that we would sue if they did not remove the false information that they have on my record, but they just ignored the letter, Dac later sold out to USIS.
    My lawyer told me that we would most likely lose the lawsuit if I cant get some employers to admit why they wont hire me. I really want to sue them, and it is about the money for me, they have cost me some really good jobs, jobs where I could make a better life for myself. They also owe me for the embarrassment of having to look an employer in the face and telling him that I didnt do the crime that I was accused of, and knowing the whole time that the only thing thats going through that employers mind is; "yeah right. You were arrested. You must be guilty of something."

    i have had this problem... the crime will show up and so will that it has been expunged.... for me anyway and i work in the nursing feild.

    My question would be what did those employers state your reason for not hiring you?

    I just read your post about what happened. That's fucked up, my condolenses to your plight.

    Did you ask your lawyer about a possible class-action lawsuit? I'm sure they are other out there who are in the same situation,their lives ruined by this abuse of information. The only way I see it possible is if you gather enough people that perhaps has evidence, so these background check companies would have to be in compliance of business rules.

    I tried to get hired by several employers, but I could get nobody to hire me, and Ive never had that problem before. I have a good work history, so I got a copy of my background check from USIS, I figured there must be some negative information on it, and I was right. I keep a letter that was sent from NCIC (National Crime Information Center) stating that I dont have anything on my record. I give a copy of this letter with my resume to potential employers, but it doesnt seem to help.
    I like your idea of a class action lawsuit against these credit reporting companies. I just dont know how to go about getting enough people together to bring up a lawsuit against them.
    I used to always try to do the right thing, and not get into any trouble, but I dont care anymore. I do what I need to, to survive. Anymore if I think I can get away with it, and it dont hurt anyone, I will do it. FUCK THE GODDAMN LEGAL SYSTEM!!!
