Holy Sh*t! Double Felony Evasion

Today was already a bad day, my friend/smoking partner got caught at school because the drug dogs sniffed out his grinder and he had a hookah in his car, he got a ticket for possession of paraphanalia and they took his hookah and grinder.

Shortly after we both got out of school we went and smoked because he didn't really care that he got in trouble... and we smoked again at 4:20 before this class we had to go to at 5.

We go to the boring class... go through it really baked (we know all of it anyways) and then leave. He has to call and get a ride home because he didn't have his car and couldn't do anything because he was in trouble. So i go and call up this other guy who just got off work that i promised id smoke out that night and we went and smoked in a parking garage that didn't have any cameras. We felt kinda shady up there like a bad vibe and moved to a bigger parking garage on the other side of the center that also doesn't have cameras. We were about 3 hits away from finishing a bowl when a county sheriff stops us (i tried to back up when i saw someone coming) and yells at us to get out of the car. We did and i slipped my new 80$ bubbler in to my pocket. We go through the whole hands on the hood ordeal and pat down/severe car search. He finds about .4 gram of weed, my new bubbler and new pipe, and my new grinder that had a shit load of nice exotic kiff in the bottom of it . He made us sit down for a while and seperated us and talked to us and explained to me that the parking garage was within 1000 ft of a school zone, so that would be a felony. And that the backing up when he was coming was evading arrest, which is another felony. He made me empty out all my remaining weed into a drain on the floor and took all my stuff but let us off. He told me that even tho he was letting us off he still would be able to press charges for it for the next 2 or 5 years meaning i can't get caught again. It scared the stoner out of me so i gotta go clean for a while.

stop smoking in sketchy places. Getting arrested sucks and is a waste of time/weed.

For one, you didnt have to get out of the vehicle. Unless he flipped on the lights and then you tried backing out, because backing up when a cop is around is no crime at all, unless you did it wildly and dangerously. And you have the right to know why you are being searched and detained, so you should have put your hands where he could see him and ask why am I being detained? Im high though so who knows if this makes sense. But it sounds more like he knows he got lucky, and if you had a good lawyer could get out of it and just didnt want to deal with it. But hey you didnt get busted so who cares right? haha

Either way he jacked some nice shit of mine. I had all my stuff stolen from me like 2 weeks ago in another terrible 3 day series of bad luck w/ weed stuff (Here is the thread on that bad luck if u never read it

no way in hell can he do shit now!! its done and over, no citations were issued there is no proof for anything, i mean he could hold onto the pieces with your finger prints(if any in good condition) possible try and do something but i would guarantee it goes no where. Besides he would look bad for letting you go on something like that... mad loot for the state. That evasion of arrest is bullshit anyway, u could have merely stated that u just saw a car coming and obviously u didn't want to be scene, and u need to be under there radar first then disappear...thats evading arrest. u basically just got caught.

I would have but it was pretty bad evasion. He got out and said stop and my initial reaction was to keep going (i didn't know it was a country sheriff) so i did and he ran up and banged on the car to stop so i did.. im sure he could get me for that if he wanted to.

County is not the same as local pd .. they have a much broader scope. if you had said "no" to him checking you he simply would have detained you and called a k9 unit... which is more time and more paperwork (not something cops desire to do) definitely would not have made you a friend. if you had insisted on leaving he would have had probable cause because of your "evading" and questionable behavior.

You're right, you lucked out .. if it had been local, it probably would not have turned out so good. Unless he filed a report (which doesnt sound like he did) I doubt he can hit you up with it later .. he just wanted to scare the shit out of you, which it appears he did .. mission accomplished

Lesson learned .. if you go out of your way to hide, you are sure to get busted.
