Rep. Elliott Naishtat recently introduced H.B. 1534, a bill that would protect medical marijuana patients from the threat of jail. H.B. 1534 would establish an "affirmative defense" law for patients. A patient could still be arrested or cited for possession of marijuana but would be acquitted in court with a written or oral statement from a physician.

This is the bill that if it passes will lower the class for possession of marijuana under 1 ounce from a class B misdemeanor to a class C misdemeanor meaning no mandated jail time along with other benifits from the lessor crime.
