CommanderChief Reviewed by CommanderChief on 03-18-2007. I JUST GOT ARRESTED and i'm super pissed. So me and a couple kids were smoking some pot and drinking and this one dude got sick. So he freaked out and went to the hospital and gave out all our names. Then I took a nap while he was apparently "dying" (stupid fuck) and then the cops came and woke me up from my nap. They were mad cool though. Very rare. I was honest with em though and they didn't even handcuff me. I'm 16 and a couple of the dudes were like 14 and 15 and now i'm being charged with Endangering the Rating: 5

If they didn't read you your rights, you can get out of the whole deal even with a public defender. Covering your own ass isn't being a dick in this case.

Miranda rights apply only AFTER you been arrested and you are questioned. Since he admitted it, he forfeited any hope of fighting it in court. Honesty is not the best policy when handling the system, silence is. Let your lawyer do the talking.

Yeah I just thought about it. I'm ok I think. They never read me my rights and I think they did it on purpose. They didn't even really care for the most part. We discussed politics and philosophy while I was high and shitfaced (im awesome at being straight) on the way to the station.


He even agreed that cannabis should be AT LEAST decriminalized.

It's pretty senseless if you think about it. I don't think you are fucked as you seem. There's alot of factors that play into it. It's important to hire a lawyer, or have your friend man up and tell them "the truth."

yeah i cant hire a lawyer tho. i'll just mention the miranda thing and see where it goes ya know.but yeah everyone is telling the story right. i'm not a minor in NY State tho. 16 is considered an adult. my other friend is fucked too cuz he's not a minor either

I can tell you from experience that Miranda rights won't work. It's only applicable after they arrest and process you. If they question after that point and don't read your mirandas rights, then you have a case. But anything you say before technically getting arrested is admissible in court.

Next time, don't say anything. Never admit your guilty, that's for the court to decide, police only enforce the law, they don't impose sentences. There's various avenues lawyers can use, but if you tie their hands by admitting it, there's not many options they can use.

There's always a public defender. That's better than none at all.
