Keep the volume on the porn down

OCONOMOWOC, Wis. - A man says he broke into an apartment with a cavalry sword because he thought he heard a woman being raped, but the sound actually was from a pornographic movie his upstairs neighbor was watching.

"Now I feel stupid," said James Van Iveren, who has been charged in the case. "This really is nothing, nothing but a mistake."

According to a criminal complaint, the neighbor told police that Van Iveren pounded on the door and kicked it open without warning Feb. 12, damaging the frame and lock.

"Where is she?" Van Iveren demanded, thrusting the sword at the neighbor, the complaint said. "Where is she?"

The neighbor told police Van Iveren became increasingly aggressive as he repeated the question, insisting that he had heard a woman being raped. The complaint said that, with the sword pointed at him, the neighbor led Van Iveren throughout the apartment, opening closet doors to prove he was alone.

The neighbor later played for police the part of the DVD he believed Van Iveren heard downstairs.

Van Iveren, 39, of Oconomowoc, was charged with criminal trespass, criminal damage and disorderly conduct, all while using a dangerous weapon, and is due in court March 5. Together, the misdemeanor counts carry a maximum sentence of 33 months in jail.

Van Iveren said Tuesday that he heard a woman "screaming for help," grabbed the sword, bounded up the stairs, kicked in the apartment door and confronted the man who lived there.

"I intended to hold it behind my back and knock. But I froze and instead, what happened happened," he told the Milwaukee Journal Sentinel.

Contesting his neighbor's account, Van Iveren said he didn't look anywhere in the apartment except the front room, and that he never threatened the neighbor with the sword.

"I had the sword extended. But that was all," he said.

Van Iveren, who lives with his mother in the downstairs apartment, said he did not call police when he heard the noises because he does not have a telephone. He said he barely knew the upstairs tenant.

Police seized Van Iveren's sword, which he said was a family heirloom.



Poor guy thought a woman was being raped and went to save her. I dont think he should be charged at all. To me that puts out the message to mind your business even if you think someone is being raped. If a woman was being raped he would have been see as a brave hero, and given a key to the city. He was just trying to do the right thing.

I don't think that guy should get charged...he was trying to save someone I guess...I don't know. This is just bizarre. And seriously, like the thread title says, keep the damn volume down. If it's that damn loud that you can hear it from a different apartment, well, then we've got a problem.

Poor Guy. Tries to do the right thing and gets hit with charges. They should charge the porn guy with noise polution or something.

I don't think charges should be filed. I think he should have to pay for the door and call it even. I think his intentions were good, why discourage future crime prevention.

It would have been funnier though if it were a couple upstairs acting out a rape fantasy. Imagine them trying to explain that one the the guy with the sword. :(

Something the same principle, but completely different scenerio i once read about.

A son was coming home from college, and told his parents he'd be home the next day. He for some reason left early, and was going to sneak into his house at night, and surprise them in the morning. When he got home, he realised he forgot his key and snuck in through the broken window that his house had.

His father thought it was someone breaking in, and shot and killed his own son. The father, who now has to live with that guilt, wasn't charged with murder, as he was protecting his wife and himself, and his son was breaking and entering.

I don't think the dude should be charged, because it was an honest mistake, but he probably should have to pay for the damage to the door.

Paying to have the door fixed is fair I think. Charging him like he was trying to break in and steal shit is just dirty. I hope the DA looks at the case and just laughs and throws it away.
The guy was just listening to porn, but it was loud enough to hear it on another floor. He had it comming to him.

fuck that where i come from if the cops had done that shit they would have called it probable cause the rape jerkist would have gotten shafted on his door by the city ... if he goes to court and can make a judge or jury belief that he believed that there was a young women being raped upstairs he should be let off because around here all you need to use lethal force is the belief you or others are being threatened with life or limb dudes gonna need an attorney though especially if he wants a chance in hell of getting his sword back

LOL, this reminds me of an embarrassing situation I had with my neighbor in my first apartment. Every night about 1:30 in the morning me and my girlfriend would get woken up by the folks downstairs watching porn turned up really loud. Our walls were pretty thin and we could hear everything and usually it was some s&m, bondage type stuff, always very vocal and descriptive. My girlfriend and I both had classes early in the morning and getting woken up every night was getting pretty old. So, one day I see the chick outside and ask if she could keep the tv down after midnight. She just gave me a blank look and said "we don't have a tv".

What kind of moron has porn blasting so loud that someone downstairs can hear it
