Something really fucked up about this.......

Its kind of a long story, but I want yalls opinion about this shit.

Okay, so my school has this new "no tolerance" shit going on which they failed to tell us students about. Anyways it happened almost about a month ago now. I had just finished my TAKS test, and as I stepped out of the room to go back to SAC(detention), my principal says that the drug dog has shown some interest in my truck, so I follow him out to the parking lot. I had vaccumed my truck out pretty damn good the week before, and I hadnt smoked in my truck since then so I thought it was going to be okay. So the guy searching my truck found nothing in the front of my truck and decided to start searching the back. It was going good until he lifted the bench part of my back seat. He started pulling up the carpet BEHIND my back seat and was digging around under there until he found a stem and 2 seeds. After that they sent me back to SAC to wait until they called me to the office. Once he called me, I was seated next to my friend, they had found 2 seeds under his backseat too. After about 5 minutes or so, a police officer comes walking through the office and says some things to the principal and assistant principal. When they where done talking they told us to follow the police officer, who then took us to the police station. We werent in the police station long until our parents came. They interrogated us, allowed us to say a few words to our parents, took our fingerprints, then put us in restraints. 2 officers walked me and my friend back to a police we where just in, and they told us that we where going to SA Juvenile/Bootcamp Center. We would be there for 2 days.

So the 2 days goes by, and we are immediately taken to my towns courthouse. And we both found out we are being sentenced to a 6 month probation period. 6 fucking months. My curfiew is 6 every night, and both of us have to go to drug classes AND AA classes.

They also found this small ass mirror which I forgot was in there, that had an incredibly small amount of cocaine residue on it. It was so small infact the police dismissed it.

We both got assigned AEP, which is where really bad kids go. He got 45 days and I got 75 days.

What makes me REALLY FUCKING MAD though, is I found out that EVERY TRUCK parked in the back row, regardless of who they are and if the drug dog actually alerted on their trucks. My truck has never been alerted on before even though I have found roaches and shit in my ash trey when putting more out after school.

You shouldn't have let them searched. I would have said no because I didn't do anything wrong you have no reason to search my car and I know there was nothing in there that the drug dog would identify

That's fucked-up!! A drug dog alerted because of a single stem and two seeds UNDER the carpet?!?! That sounds like a bullshit, witch-hunt charge.

Appeal it. What they found was a miniscule amount, something you couldn't even smoke..let alone get high off of to begin with. They're not punishing you for having marijuana in your vehicle on school property, they're punishing you because they found evidence that tells them you should be punished because you apparantly have something to do with marijuana..ridiculous.

Yeah, but there is nothing the students can do, they have to go along with the search. Also I forgot to add that they charged me with a CLASS A MINSDEMEANOR since it was in a drug free zone.

Schools and drug-free zones are much tougher places to be these days, what with zero tolerance. And students' fourth amendment rights aren't honored in the same way adults' are out in the rest of the non-public school world, which the courts have consistently upheld. I'm assuming you live in Texas, right Smoke 2? You mentioned TAKS. Real sorry that happened to you. Seems plausible to me that what little they found in your truck could have been there as a result of the previous truck owner, but, of course, that's the it's-not-mine story everyone tells when they're busted, so no one in law enforcement ever really believes it.

If it was on school property they can search no matter what. I NEVER parked on school prop. Two of my friends got high as hell before school one day, they actually got caught by a teacher saying that they were high, they go to search there car and it is off school prop. so they couldn't do shit. They ended up doing nothing to them.

No, I didnt try to deny it, it was mine. But im pretty sure I didnt put it there though.

When I was in high school and they started that. Every student had to sign a form about it, plus it was mentioned several times a day when they first started.

Search and seizure laws applicable to the police are generally not applicable to school officials, teachers, counselors. Lockers, personal items, pockets, cars, and so forth could be subject to search. Just as with the police, do not consent to the search. You cannot physically resist but you can say, "I do not consent." Makes sure someone hears you say it too.

The search is lawful if the school has a "reasonable suspicion" that a school rule has been violated. This means the search must be justified when made and reasonably related to the circumstances being investigated....so why were they alerted to you?

The prosecutorâ??s office must file a petition with the court charging you with an offense(s) within at least forty-eight court hours after your arrest. Your first hearing must be the following day.

With just a stem and seeds what did they charge you with? Did they read you your rights? You need a good lawyer because if you only had a few seeds they've got NOTHING and holding you or sending you anywhere violates YOUR rights. What do you parents have to say about this?

Schools are friggin fascist places. It annoys me to no end the level of professionalism they expect, yet they treat us with none. Just to spite them I'm going to become the next mussolini and blame it on the school teaching me how to be fascist.

I've been through this crap with my son....here's my story

My son gave a girl a phone number of a mule that he got from his brother and this girl got caught with 5 lbs...so they called it a conspiracy...they need 3 people to charge a conspiracy so they got her, the supplier and my son.

lots kids in school knew that connection it was no real secret but they made a huge deal out of the arrest because it was on a school bus crossing from Canada to the US....

they asked my son to take a lie detector test He did and was asked if he knew this guy and if he EVER smoked. He passed with flying colors. SO then they said oh well it is not admissible in court!!...Then why the hell did they bother?! He was even on tape on the school bus telling this girl DON"T DO IT....They still charged him because they wanted him to say he had seen my middle son smoking pot!! My middle son had been caught with a joint so they needed a scape goat..he ran away because the keystone cops scared the hell out of him.

They wanted my youngest to rat on his brother and when he refused they put him in jail! They believed his brother was involved which he wasn't. He was home with me so I knew he was telling the truth.
I went to the principal's office and talked to him and he tells me "Man it looks like your son is getting a bum rap!" He knew he was innocent...but did nothing and I could not figure out why...

The entire student council testified on my sons behalf but they drug it out forever.....it cost us a fortune and the truth finally came out. My son was innocent and the judge could not believe they ever charged him! It took almost a year!

so now we are in the process of suing the school and the police department because it was the principal that alerted the dealer to the bust (he was later fired) he was sleeping with a lady on the education board that also dealt weed and they were using kids as their cover!!! The cop even put a gun to my 17 year old sons head and said "I am the law" can you believe that crap!! I want his badge so bad!! This case was so blown up it was in Time magazine and has been in US and Canada newspapers.

I still get angry thinking about it....its been 4 years and it is still not over!

Yeah, I knew some ppl that happened to in high school, over 2 seeds. That 0 tolerance shit is such bullshit. They take it way too fucking far, its like a power trip for most school officials. And ppl wonder why kids get sick of this shit and start shooting. The world has gone to hell in a handbasket if you ask me, and its only going to get worse. Before long you won't even be able to take a shit in your own home without someone chaperoning you to make sure you wipe from front to back. Lol, sry, not much of that makes sense, but man i'm pissed. Sorry that happend man, I fucking hate the nazis employed by the public education system. The shit they get away with is outrageous. I don't know when the schools quit having to obey the laws the rest of the country follows, but apparently you forfeit all your rights until you graduate.

Conspiracy charges are complete and total bullshit. There was a man in Indiana that is serving a life sentence, because he gave somebody looking for weed a dealer's number; and the guy ended up buying like 100 pounds. I don't remember his name. I work at a law office, so I read all the time about people being stopped for literally no reason(sometimes suspected of being intoxicated while riding a bike!), then the cops don't tell them their rights, and they end up getting busted without doing anything else illegal.

Out of principle, I never consent to any searches or seizures. Whether I have anything or not.

your also from Canada, A guy I know has been caught with shit loads of extacy, has been caught getting high alot of times, been suspended like 10 times and is still not going to jail, doing any community service or any crap like that.

Like people have said before I would appeal that forsure.
