Need help, caught at school...
On Thursday, March 30th, I was caught with paraphanelia on campus. It was during my 5th period class when I was out to P.E. when my school advisorer searched my back pack wich I had left outside while we went on a run. I had a glass spoon hidden inside and was susspended for five days with a recommendation of expulsion. Today my princeple informed my parents that they have come to the conclusion that expulsion will take place. After talking to the head of my school he has decided to have a talk with me tomorrow at 7am but to not give our hopes up because expulsion will still most likely take place. Does anyone have any advice on what I should do or say tomorrow that could get me out of this situation? I do not wish to transfer schools and leave all my good buddies behind.

i dont believe that the school has the right to search your bag with reason and your consent! so if you got a lawyer you might get back in but it will be a lot of trouble! call a local lawyer and tell him your situation, he should tell you if it can be won and you shouldnt be charged for the consultation. thats about all you can do! or kiss there ass!

I don't know. You give up a lot of your constitutional rights once you step into a school (free speech, right to bear arms, right to assemble...). I bet it was perfectly legal.

I'm not sure about that Oneironaut, one time when i was at school, someone gave them an anonymous tip that i had weed in my car, and they still had to call my dad to get permission from him to search my car.

But if it was legal, then at that meeting you need to do some MAJOR ass kissing. Dress up very nicely, and when you go in there be extremely polite, and just tell them you are extremely sorry and it will not ever happen again and you would like another chance to prove you can change.

They are allowed to search any and all property on their property. And for 'dood989' it was because you were under 18, probably, is why they called your dad or it could have been in his name.

No, they aren't.
Number one they aren't law enforecment, they don't have the right to search a godamn thing. They will however expell your ass unless you get a lawyer involved, which should be the first thing you do without even thinking.

ok this is how it is at my school...if its in your locker, then they can search ONLY the locker, unless your bag is open and they can see inside. And they cannot search the cars unless something is in visible site without getting in the car. (unless they get an "annonymous" tip or something along those lines)
Actually, my friend was suspended last year because a teacher found out he had bud, so he threw it in some locker, but a teacher saw him do it...he should of just hid it in his back pack.

The main problem here is that you will get taken advantage of if you don't know the law. I'm telling you, get a lawyer or you're going to get screwed. Authority has been doing it since the beginning of time, if you don't know the laws you will be taken advantage of.

I really hate it when people spout off and post this nonsense, I was in a similar situation in highschool regarding something other than drugs and I got my families attorney involved. What you're saying is wrong, atleast it is in my state. Go to an attorney that knows what they're talking about, not a kid on a internet forum, jesus.
I'm amazed this question is even being asked on a forum. If you stepped on a land mine are you going to ask some people on a internet forum that are 17 years old what to do or are you going to call a demolition expert? Call your lawyer.

im not sure if they themselves can search your belongings because when i got ratted on (dont we all love jr/high school kids:) ) they brought in a badge and he had to be present during the search of my stuff and locker took place. Luckily i had gotten word of the snitch and stashed my bud pipe and switch in my shoe and they didnt check there. Id do what they say and brown nose the shit outta them, tell them that your diploma means alot and you just made a bad choice and are sorry and that you really would appreciate it if they would work with you instead of just booting your ass out(not in those words obviously)

I'm not sure where you go to high school, but at mine, they can search you or anything on you including your backpack or locker without your consent. I don't go to a public school so i think i sort of lose my rights at school. But if you are at a public school you might have a case agianst the school.

can someone please tell me the big thrill about bringing weed to school. please i would like to know why so many people feel the need to take that big of a risk to have some weed at school. also, if it is the same as it is for law enforcement, and i have no idea if it is, if you looked stoned at the time, they smelled it on you, you were acting stoned/suspicious, or someone told them you had it, any those would probably be enough, but i still think you have to be made aware of it. fuck at my school they hauled all of us into the gym for an anti drug assembly and just had dogs go around and sniff out all the lockers so theyd be able to search. anyway if they didnt get your permission you should be fine if you were to threaten to sue the school or something.

Just because the teachers say that doesn't make it true. Just because you enter someone elses property doesn't mean you lose your rights, in theory you're ALWAYS on someone else property unless you're in your home.
Based on the logic of some people in this thread a person has zero rights unless they are in their own home.

that shit wouldn't go anywhere in Canada. If there's laws in your state that let random people access your personal belonings, on their property or otherwise, then I suggest you satrt to question your "freedom".

I do believe that in the state of Illinois it is legal to bring cops and/or police dogs in to search. As suhl said above, at our high school they brought us into the gym while the dogs were sniffing out cars and lockers. Tadaa, don't be so quick to spout off some hasty remark douche. You are right, though, your lawyer is still the proper person to ask. You don't have to be such a dick about it though.

I just found out that its legal for my school to perform search and seizures so I assume a lawyer is useless in my situation. Ill guesse tomorrow Ill be doing some serious begging and trying to work with them. Thx for the advice, Ill let you guys know how it goes.

lol, and how exactly did you find this out WITHOUT talking to a lawyer? I think it's funny how you've come to the conclusion that it's legal for the school to search your book bag but you have yet to talk to the only person that knows this for sure, your attorney.
If you didn't hear this from a lawyer you probably heard it from one of the following completely usesless souces:
a parent
a cop
a faculty member at the school
None of which have any clue as to what the law really says, trust me. If they did, there would be no need for criminal lawyers.
Don't get me wrong, you may very well be right, but unless that information came from a lawyer, which it obviously didn't based on your post, you have no idea if it's true or not.

Well common sense also has to come into play. Serious, if a couple cops come to your school with dogs and do a somewhat thorough search of the whole school, then 9 times out of 10, its not going to take a genius or even lawyer for that matter to know that it's legal. I don't know, maybe your a lawyer and just love their usefullness or something, but I wouldn't want to pay for something when all I had to do was open my eyes to find out.

okay here's the low down on what the schools can search.
1.They can and well search your bag's
2.They Can and well also get into your cars
3.Anything you got they can search
it's a proven fact that your voice or option does not matter in school. I have ask and heard teacher saying to me and other class mates that a student has no rights.
More then likely the school is gonna screw you like they did with me.
for example 2 weeks ago i tried Signing out to a alternative school (With means you can get a High school Diploma, or a GED (Adult Ed as well))
And well they state in their policy once a student is 16yr's old you have every-right to sign up there anytime, well to make a long story short. they denied me with no reason (Even when i ask, they ended up saying they didn't have to tell me)
i have two been search a few times because of people not shutting up when they wonted to go though me to get more weed. (Lucky i was never caught) but they never have to ask a parent or student to be search at any time.
but hey you may get a lucky break. but it seems for me i never get one, always denied, denied, denied :(

lol, you heard this from a teacher, my argument stands. Last time I checked highschool teachers don't have law degrees.

So based on your logic a teacher can give a black student an F because he's black. And technically, a teacher can't deny a student the right to use the bathroom, that's a law.
