The ruling of Judge Francis Young
Howdy Y'all,
I would like to submit the following :
" Interestingly, in a 1988 ruling that marijuana should be reclassified
to allow medicinal use, Drug Enforcement Administration Judge Francis
Young concluded that "In strict medical terms marijuana is far safer
than many foods. For example, eating 10 raw potatoes can result in a
toxic response. By comparison, it is physically impossible to eat
enough marijuana to induce death. Marijuana in its natural form is one
of the safest therapeutically active substances known to man. By any
measure of rational analysis marijuana can be safely used within the
supervised routine of medical care." "
I'm thinking of printing the above out and taking it with me to court to submit to the judge in my case and and making it a part of the court record, what say y'all ?
Have a good one !

I may be wrong but Torog you are disabled aren't you? We live in a very fucked up place where genuine people like yourself are not allowed to choose the pain relief of there choice. Especially there are states in the USA that are allowed and some that are not.
Also wearing that t-shirt to your hearing will be a huge slap in there face you should wear it.

Hello Torog. Do you have a MedMarijuana liscense in your state? If you do, the law that applies to your situation would be different than if you did not have the liscense. Arguing the law is easier if you can argue within the framework of the state statute that granted you the liscense (in Colorado there are some neat defenses built into the law). If you are not a liscense holder, a 1988 ruling would have to still be good law in that it would not be over ruled by now. You have to go to the case that held that ruling and "sheperdize" it to confirm it's still valid. As for the tshirt, I think it would only piss off the judge, a bad idea. Try a suit instead. Good luck, my man. The law is just only if you get off! Really, all the best.

I don't know much about US legislation (the gist of it), but I think those are legal precedents that will be regarded as relevant in court.

The ruling of Judge Francis Young
Seems like it was overruled though
Quote:
DEA Administrator John Lawn subsequently overruled Young's ruling. NORML filed suit, but the U.S. Court of Appeals upheld the legality of Lawn's action. Although marijuana remains in Schedule I, Young's decision has been quoted countless times by activists seeking to legalize medical marijuana.
DEA administrator Robert Bonner overruled this shift to schedule 2 for political reasons. So they can expect you're going to bring that up, since cannabis activists have used this document a lot, I'm sure the better judge would be aware of this. imo
all the best man

Howdy Harvesthetic,
Thanx for that info,I figured something like that happened.
As for the judge here,I doubt if he's ever faced a activist in his court for medical marijuana, but I reckon that it's 'high' time he did ! lol I'm pretty sure, that the judge I will face,is one of them mean-spirited Christian rednecks, that we have alot of here. The president of D/FW NORML,said that he would be willing to even organize a protest for me,that would sure shock these rednecks around here !

Sweet as pie man, I remember reading it's a beer coolie thing before but everytime I see it, I think it's a flashbang or a smoke grenade or something haha.
Also when you say "100% disabled" I'm quite sure you don't mean Steven Hawking style or anything as "severe" lol..

Howdy 3 Sheets,
Yup..I ain't disabled like Hawking is,I'm still ambulatory, but I do need a cane for when I go walking more than a few blocks or if I go to shopping at the 3rd largest wallyworld, which we have here, because Sam's daughter has a ranch here.
Now how in the heck-can ya mistake a beer coolie for a grenade ? lol
I wish that I had a couple crates of frag grenades:D I reckon smoke and flash-bangs would be useful too,but if I open a can whoop-ass,I want it to be the real deal:thumbsup:

Haha cheers for clearing it up.
That picture's sweet man, but I was about 80% sure you were just going to put a picture of "Timmy!" there 'cause of me being led to believe you were 100% disabled :D.
Personally I'd recommend some of those futuristic "sticky" grenades you get on Halo, but as I don't play Halo I dunno what they're called.
Take it easy and have a good'un lol! :)

Hey, Torog,
I didn't know Texas was considering medical marijuana. Texas is so ultra-conservative(except when it comes to keeping their guns) I didn't think they would ever even entertain the thought. Glad to hear they are!
Hi from the Gulf, BTW.

Howdy gangagirl,
No maam,I don't have a lawyer yet,I'm in Texas. There's a list of lawyers doing work for NORML in Dallas and I need to find out if any of em will give me a free consult, because I'm too broke to pay attention and when they find that out, they'll probably drop me like a hot potato..lol..if I were a well-to-do feller,it wouldn't be a problem.

Howdy lemonboy,
Hmmm...you just might be onto something there..it's just hard not to be pessimistic, knowing that I ain't got the money to pay for high-fallutin lawyers.
We have a good-ol-boy network in place here,if ya got the money, charges seem to mysteriously dissappear,if you pay the minmum, they screw ya,if ya pay what they ask for - the system seems to work smoothly.
I can't imagine what the good ol boy's reaction would be,if I were to bring a lawyer into the equation, that's outside of their cozy little world they got here..lol.

The ruling of Judge Francis Young
Howdy Y'all,
Well..my court date is set for Feb 28..pretty dang quick, considering that my gal's court date ain't been set yet..I hope it means that they will just drop her charge.
I talked to one of the lawyers listed with D/FW NORML yesterday, and he said that I should demand a public defender and probably go the deferred adjudication route. I told him how I felt that the task force and the fed, probably violated my rights and took my smoke improperly and he said that it probably was,but that the cops will lie to cover their asses, that it was a given. He also said that the fed wasn't going to try and take my case to the US attorney, because my 'gifts' were so small, that it wasn't worth the time and hassel for em.
I also told him that I was 100% disabled and that I have a very limited set of guide-lines that I have to adhere to in regards to my physical limitations, that would preclude me from doing most community service and such,he said to be sure and inform the judge..I will most certainly do that !
Another interesting thing is,is that the task force that came to my home that day, will be disbanded at the end of March and I'm wondering if I took the case to trial, that it would be difficult for the county to git the narcs to testify at my trial, because they've been re-assigned elsewhere.
I just don't know what to do-should I take DA or is it time for me to make a stand and stand-up for medical need and decrim ? If I lose the trial, the maximum sentence is 180 days in county jail and a 500$ fine,I believe. The president of D/FW NORML,said that he would organize a protest for me at the courthouse if I want. The lawyer said that I would make a good poster-boy for the medical marijuana issue and that MPP would probably want me to go to Austin and testify about my medical need.
What say y'all ?
Have a good one !

I say do it! You would probaly do great and help starting putting necessary bills on the ballot. If you havnt realized it yet, Austin is a city mostly made of Hippies and Reformed conservatives that would fight for your right of medical use as much as possible.
If any of this does get under way, drop me a line and I might go check out the protest or help make signs or something.

I'll be thinking about you on the 28th, saying a little prayer that everything works out for the best.
As far as the legal options....I'm not sure what deferred adjudication IS!! So, I can't help you there. I think it would be great to get your case in front of the media, you have such extreme disabilities and MJ helps you sooo much. Ultimitely it's up to you whether or not you want to put your pretty face in front of the cameras!

Howdy likemclever,
Well..I don't know yet, just what it was that got me busted,I just know that I got visited after recieving small gifts of compassion,in the mail. Customs did intercept a gift from the nederlands, but I didn't respond to their letter and it was months and months later, that I got visited. On the morning they came to visit me,they claimed to have intercepted a gift from vancouver and they said that they had to put a stop to me gittin gifts in the mail. The un-identified fed,who did almost all of the talking, said that the amounts I was recieving, were too small to prosecute and he left it up to the task force to decide whether or not that they would press charges for the weed they took from my stash-box..well..I reckon that they changed their minds and decided to 'walk' me through the system. This all happened last August and they sent a deputy to arrest me on Jan. 14th.
Have a good one !
