You can now open a business in the state of Oregon that includes live sex acts as part of your inventory. You might call it "Vinny's Deli and Sex Act Cabaret," or "Miss Sally's Spa and Kama Sutra Emporium." That's because the Oregon Supreme Court recently ruled 5 to 1 that telling a business it cannot have a live sexual exposition on its premises is a violation of freedom of expression under the Oregon Constitution.
Incredibly, the Oregon Supreme Court believes that the state or local governments have no right to limit sexual "expression" in a public place. The U.S. Supreme Court has ruled time and again that authorities do have a right to regulate expression when it collides with public safety or community standards. You can't have sex on your front lawn even though you are "expressing" yourself on private property because that expression would violate a societal norm.

But the Oregon Supreme Court doesn't seem to care about society. That state now has doctor-assisted suicide (being challenged in the U.S. Supreme Court as we speak), some of the nation's most lenient drug laws including almost total access to medical marijuana (have a headache, forget aspirin, here's a brownie), and now live sex at a saloon near you.

But don't do any cigarette smoking in that saloon. That's been banned in Oregon, and it's also illegal to pump your own gas. Apparently, smoking and filling up your vehicle are not expressive enough for these dopey judges.

The driving force behind the sex in public deal was, no surprise, the ACLU, which filed a friend of the court brief egging the Oregon judges on. The ACLU is big on expression, as long as it doesn't involve singing Christmas carols. Yes, you do have this right: the ACLU is bullish on public displays of sex, but bearish on public displays of the baby Jesus.

A person from Lithuania might think this is a humor column, that I must be joking. I'm not. This is exactly what's going on in Oregon and with the ACLU.

I'm not analyzing this from a moral point of view; the live sex act thing isn't all that important, in the vast scheme of things. Nevada has legal prostitution in rural areas, and the state has not crumbled. But the perversion of Oregon's state constitution is troubling.

Freedom of expression as defined by the founding fathers is a concept subject to time, manner and place limitations. Laws against hate speech, disturbing the peace, public lewdness and scores of other "expressions" are enforced daily in order to impose some order in a nation of 300 million people. The judges in Oregon understand that, but don't like it - so they have decided to erase societal boundaries under the banner of freedom.

This is where the nation is headed under the secular-progressive jihad that is being waged all over America. With apologies to Home Depot, you can do it - the ACLU can help. It has been said that freedom is just another word for nothing left to lose. But if we lose all standards of behavior, are we really free?

some folks centre their whole lives on whether they want to lick carpet or reach around each other, it is ridiculous and very sad to base your lives on this, there is so much more to life.

You obviously dont know anything about this case, it spurred from a Oregon town wanting to Ban stripping in their town, They passed a law, then it was overturned by the Supreme Court in oregon, saying Adults can have sex anywhere they want, be it on public property like a school, or in a stripclub.

I don't see anywhere here that this is "subject to time, manner and place limitations." Maybe that's something Bill would like to add to the constitution. In my humble opinion (which is worth as much as Mr. O'Riley's, that is to say it's only worth shit) that one should challenge "societal norm(s)" everyday. Some people feel that the have a right not to be offended, all I can say to you is: Quit being a bunch of whiny pussies and get over yourselves! Do you really think that your insistence that everyone should conform to your nineteenth century views is just? You're so complacent in your comfort zones that you'll subjugate your views on the rest of society. Why should those who want to keep moving forward be impeded? Why don't you kick start your ass and move into the next century. If you want to live in the past get a job as a re-enactor. Don't be so concerned on were we can be, focus on where we could be.

My point is,is that I don't want America to be turned into a place,where debauchery reigns un-checked, I want America to be a better place for my daughter and all of our children,than when I finally git called home to God. If yer not a parent,you may not understand. I'm all for freedom of speech,but at some point,we have to grow up and be role models for our children. Do you really want to go into a doughnut shop and have a live sex show to watch with yer mornin coffee and donuts ? How about a live sex show in the back of the toy store ? Society has to draw the line somewhere at what's acceptable and not,in the public square.

Like I told nicholas,I simply want America to be a good and decent place to raise our children..I don't want to go overboard and stifle free speech..but why should parents have to explain to their children,what a live sex show is and why there's one in the back of the toy store or the donut shop. It was bad enuff,during Clinton,that millions of parents had to explain to their children,what oral sex is..when those children should not even be thinking about sex at their age. America,does not need to devolve to the level of european countries,in order to protect 'free speech'..we should be good role models for our children,not shoving sex into their faces,at every turn.

that's exactly what parenting is, torog. it's your duty as a responsible parent to take a few minutes out of your day to talk to your kids about how you feel and how THEY feel, not just assume you're doing the best thing for them by censoring stuff from them.

sex is human nature. do you think by stopping your son from watching porn, he's less likely to jerk off? by stopping him from smoking, he's not gonna sneak and do it?

parents have to explain to their children all the time, most of the time the kid already knows.
if you want it good and decent, then be good and decent yourself, it must start with you, and you cannot foist your morals on anyone, being good and decent as you are.
i don't know how many kids you got, i got lots at least four who claim me as dad, every one of them when growing up went through a sex thing, the girls played sexy with the boys and the boys got little hard on's and chased the girls. they were not told it was bad, today they are all well adjusted happy adults with children of their own. it is not a bad thing, God watches porno, and it ain't on the net, he/she has his/her own screens. look around the next time you are having sex you will see God and he/she will see you, better do a good job.

Not so, Torog. It's because of such a taboo about things like sex shows. That means all th hard-working honest citizens dont go because they're afraid of being marked as some pervert.
It's the "bad" people that dont care and go, which gives the image that only "bad" people go to such things. Its akin to politicians advocating reforms on pot laws. Noone will touch it because they dont want to be viewed as a stoner who smokes bongs all day.
If more "good" people went to the sex shows, then im quite sure they wouldnt tolerate bullshit from some weirdo in the corner.

Here in Toronto, the downtown area we pretty much have a porno store on every corner with big signs advertising whats inside...it's on yonge street right before you hit the Toronto Hemp Company and the theatre where they play the Vagina Monologues...amazingly though, the society hasnt crumbled, the gangs stay in the bad part of town and children walk about completely carefree in their innocence... but hey, that's just what happens in the real world...i suppose there's something in the drinking water that makes americans so different.

We should have legal brothels in the United States. Amsterdam, when I was there, had a "red light" district. We've had them in the U.S., and still do - in parts of Nevada. I'm Torogs daughter and I was never "repressed". I never rebelled, never had a reason to. I do, however, happen to agree that sex in public is just..well..gross to say the least and it reduces us to animals. We are living in civilization, in society, not the wilderness. I would like to think that humans are more civilized and have more control over their primal urges than animals.

What the politicians and law makers do not understand is that people are basically responsible and things like these take care of them selves like neighbors being dicks to them and other businesses shunning them cuase businesses can refuse service to people if they want. Yeah, matter of a fact I want my daughter to grow up in a world where sex is normal and god is veiwed as a perversion, because that is the truth. Are you incapable of selecting a doughnut shop which fits you world view? Perhaps you are, but that really isn't my problem.

THANK YOU! I sick and tired of lazy parents using the government to raise their children! Why don't you do it yourself? Just because you can't put forth the effort to raise your kids properly, doesn't mean you should make life difficult for responsible adults. Instead of lying to and sheltering you kids try talking to them, they're smarter than you think, if you don't tell them they'll find someone who will.
