Well, Like Skynrd Said...

So, I got up from my computer a couple moments ago and paced throughout my room. I found out this morning at around 9 am that I failed my court saliva test. I came back positive. My probation officer said that they'll set a hearing and there are a variety of options the judge can carry out. He can

- Extend Probation
- Extend Probation and up my couseling session
- Extend probation, send me to a juvenile detentional facility for 3 months

So, as I was pacing I turned and looked at my poster on my wall and looked at the word MARIJUANA at the top. Lynyrd Skynyrd's Free Bird was playing and so I said, "Well, Mary Jane, bye and bye girl, it's been sweet love. Though this feeling, I can't change."

My every waking moment has since been consumed by this menace that is running around my head. I can't stop worrying about what's going to happen to me. I live in Indiana, and I'm a minor on probation for reckless possession of paraphrenalia. My first drug test was about 2-3 weeks ago, it was a saliva test. I had been on probation, roughly, 2 months before this test.

My hearing will probably be the 17th of August. I've been reading around, and it says that should you ever fail a court drug test, raise hell. Swear up and down that you hadn't smoked, ask the court to test you again, and that you'll prove it.

The reason why I failed my drug test was because I was going to use Certo on the day of my test. So, at 3:30 in the morning (I'm usually up until 7-8 am) I took some resin hits from my pipe. So, I went in there thinking I was going to pass their pathetic little piss test. Only to be surprised and side-swiped by their SALIVA test. I was fucked. I knew it.

So, now, I don't know what to do. I'm completely depressed about this entire thing, not in a self-pity mopy kind of manner. But, no matter what I do, or how busy I keep myself its always in the back of my mind keeping me from being truly happy now. Does anyone have ANY idea as to what might happen?

The day of my hearing I'm going to use Certo with Gatorade, as well as eat lots and lots of red meat, I'll probably end up taking creatine pills to keep my piss yellow, as well. I'm going to raise hell because they say that an innocent always does. So, I'm going to tell the judge I hadn't smoked, see if I get tested before the judge rules anything, and pray I pass.

I'm basically just wondering if anyone knows the law and what usually happens in this kind of situation. But, I guess it's sorta hard to tell the future.... :(

I just know that there is really no way I can make it in a juvenile detentional facility. As much as anyone thinks its nothing big, believe me, I'm a wuss and not the kind of "hardass" or whatever that could take it. If I ever got sent to prison, I'd PROBABLY have to hang myself, lol. Seriously though, juvy really isn't for me.

if you lie and say you didn't smoke then come back positive the judge may just be pissed enough to put you in comtempt(yes they can do that,in that courtroom they are god and they know it)so dont cry inocent unless you are 1465793460760647664565656546% sure you will pass and not to sound harsh but you put yourself in this situation,as much as i hate to say it.but i dout they will send you to a juvinile detention center,but ask who the judge hearing your case is and try to get some background information on his/her ruleings,and your going to HAVE TO quit smokeing,cold turkey,no more till your off,if you fail again the will 100% send you to a juvinile detention center for three months or more if they can manage it.but good luck,hopefully you'll just get a few months more probation,hope for the best but expect the worst :( i followed your first thread when this all started and i know you've had some rough times,so good luck

Just tell the judge you were hanging with a friend, and they gave you a brownie and it ended up being cooked with MJ in it and they didn't tell you. and that had you known you would not have accepted it because your on probation. End of story it wasn't your fault, and you don't have to lie about your test which will get you in deeper shit, your in a hole dig yourself out not deeper into it! :eek: Good luck on your hearing. Yeah, I definitely know I'm the stupid son-of-a-bitch that put myself here. I read before I was put on probation, and heard through the grapevine, that if you're under 18 that your parent/guardian can tell them they don't want you tested. Well, after I was tested the first time, I thoroughly researched into that, and I guess that's only if it's not a drug-related offense. Like, say you're put on probation for having violent outbursts and tendencies, then they might ask your parent if they want their child drug tested. If the parent says no, they don't test.

Well, with me, I thought that's how it was. Because the first time I went in and met with her, I didn't get tested.

Also, either way, I'm fucked. There is no way I'm going to pass any kind of drug test 100%. I'm 6 foot, 235. I've been smoking for a year, the past 5 months or so I've been smoking almost daily. Just a couple bowls a day, but still. I highly doubt I would pass even if I had quit smoking when all this had started. I'm definitely quitting in 2 weeks. I'm going down to Florida to see my girlyfriend, smoke out with her because she hasn't seen anyone in months, after I return home...I'm not smoking anymore until probation is over.

It really sucks because, as my mother said today after we heard the news, "This is your senior year. It's supposed to be the most fun you have in high school." Well, my retort was, "Yeah...it wouldda been...IF YOU HADN'T CALL THE HAWAII 5-0 ON ME, WOMAN!" :) Anyway, the point is, I am quitting in 2 weeks, probably about a week. Thanks for the reply KronicKing, you don't sound harsh, just truthful.

And I understand about restraint and all that, but it was just a really stressful thing. I'd had a 10 for over a week, and I hadn't smoked in about 4 days. It was the night before the test and I was just pacing everywhere, I couldn't settle down. I was anxious and nervous, and it showed. I didn't want to smoke weed, but resin hits usually just make me lay down. That's what I wanted, not to get stoned, just to relax. It worked, I was able to stop thinking about it, and just watched a movie before going to sleep.

Okay, well, I just got back from Florida and decided to bump this mostly because of nerves. I was down there for over a week and my family was/is pissed at me because the entire time I was, "a stick in the mud." I was really pissy and quiet instead of lighthearted and talkative.

The reason being is because I just couldn't stop thinking about court. I'm so afraid of going to juvy. I sorta smoked last night. It was shitty, SHITTY weed that looked like leaves that were really dry and brittle. There were no hairs, and they had found it in their closet after losing it for 2 years. She said when they found it, it had mold on it even. But, we smoked about 4 bowls and a joint of it. It was worse than schwag. I can't tell if I got stoned, because I was so drunk. But, I was extremely fucked up either way.

I've called my proby officer twice now and both times she's said that it's basically up to the judge's discretion. Whether he is in a good mood or not, and how good my excuse is. I talked to some friends and as soon as I mentioned the fact that I failed my drug test, they said, "Juvy." almost at the same time.

I have been almost on the verge of tears because of this. I mean, some people might say its' not that big of a deal, but you really don't know me. lol I seriously am not one that could make it in juvy. I'd end of killing myself just because. I mean, sure I'd probably get used to it after a while, but I heard that the first week or two is the hardest. I did hear that the kids are really cool in there, they won't fuck with you or be a dick. THey'll ask you what you're in for, and it's basically like normal kids, who are in juvy. It's just being away from my friends, and my home for so long. Being without you guys and gals is also another twinge of pain.

Anyway, here's almost word for word what I want to say to the judge, and I was wondering if you guys think its good or not. The last time I saw this judge, he was very courteous, he almost bordered on nice. He didn't have this attitude that I was shit, just some kid, so I'm hoping he is the same way, and that he will opt for an extended probation and/or community service instead of juvy for 1-3 months.

Judge: Do you have anything to say right now?
Me: Your Honor, I will admit that after the incident I didn't wholly quit. I am human, I made a mistake. The day before I was tested for probation, I was around it. I didn't expect to be, I didn't think that it was going to be anywhere near me. I didn't want to put myself into a situation where I might faulter. I didn't smoke, though. I'm willing to take a drug test right now to prove that I haven't been smoking.


I talked to a friend's mom last night who works at the court house and she said that Sure-Gel (Certo) works, but that you have to be careful. It makes your piss white, and if you use creatine pills you have to make sure its not too high. She did that with her son, and they said that his creatine levels were too high. Does anyone know what normal creatine levels are??

i can't belive our courts are being overun by pot cases. It's so stupid. Smoking weed doesn't harm anyone!

Man, I'm really sorry that you're having to go back to court, that blows. :( Hopefully you will just get the extended probation and no juvenile detention.

I don't know much about the juvenile justice system there, but I know here if you aren't violent, and haven't been in trouble for violence-related crimes you pretty much just get more probation time and fines. Good luck. I tried googling for creatine levels, but all I could find was stuff about blood tests and 24 hr. urine tests.

i don't think you'll get juvy,but you may,i hope not.gook luck man!and if your SURE you will pass then go with that exuse but beleive me if you lie to the judge will will come down hard,he may even put you in comtempt of court,like i said,they are gods in that court room.let us know though man and best of luck!

You say that, they will pick apart every word you say about that evening and events. You get caught in that lie, you can bet you will get double time. Just take it like a man. You broke the law, you are defenseless against law. Hopefully all goes well for you, good luck. 3 months isn't the end of the world. Work in the kitchen, have good behaviour, you'll be out in a month. Trust me, I've been there ;)

They found THC is his salvia, that's what's happening here. Insence don't burn off THC. The courts aren't stupid man. They aren't as gullible as your mom, dad, sister or friends.
