Hey, I was smoking some great bud just a while ago and i got to thinking...is it possible for people to get together and SUE the government? What if you were able to build a claim that the government ILLEGALLY usurped your right to smoke? I mean think about it, since it's been medically and scientifically proven that cannabis smoke does not effectively harm a human being and also provides beneficial qualities isn't it legally damning for the government for invading on your constitutional rights? People with relatives who've suffered could build a case that they've been wrongfully kept in pain before their death. Also, what about the basis for which it was first made illegal? Jesus christ, cmon everyone! Anslinger's testimony was deliberately falsified and when since ever has that not been full reason to throw cases and rulings out? I think this is the solution for legalisation or at least decriminalisation? What do you guys think? im going to post this in the legal forum too.

I know what you mean, and I think marijuana laws also infringe on our constitutional right to privacy (privacy in what we do to our own bodies counts too). I would say no but their have been some really weird lawsuits in the past.
The Florida man who succesfully sued a ladder company for not printing "do not use during a hurricane" on the ladder comes to mind.

I think we had the same thread by someone else about a month ago, and it was determined that no we can't.
basically, making marijuana illegal falls into the same category as any other drug, as well as suicide. of course in the real world it's pretty harmless, but so long as most are misinformed, they're just "protecting" us from ourselves

just so you know you cant sue the government or the army, it is legally impossible just about, think about it otherwise another country could come up to us and sue us for all were worth because of some stupid nothing, too bad its a good idea

Countries can't sue countries. Countries can have businesses in a country and file a legal suit in the respected courts, but it would be the same as an American company suing the government. Even then, it's hard to sue the government regardless.
And by the time anyone could even try to form a class-action lawsuit the case would've already been thrown out in court. As much as we love weed, there has to be SOME justice when it comes to sticking to laws, otherwise no one would take the legal system seriously.

I have no idea why this old, old thread from 2005 even got re-activated. It's an amazingly stupid one. Folks can't sue governments, and oil companies didn't make pot illegal. If anyone in big business/industry has conspired to do that, it's been big pharmaceutical companies, not oil. Oil may be invested in keeping hemp and hemp oil illegal and hemp fuels on the down-low, but not recreational/medical weed.

Well i think an important factor to look at is the reason why marijuana is illegal. Alot of people have the misconception that marijuana is illegal because the U.S. Govt thinks its harmful and destructive. But we have to understand who we are dealing with. the govt. isnt stupid. they know for a fact that weed isnt dangerous. they also no that it isnt addictive and doesnt lead to violence. marijuana prohibition is a form of revenue in the U.S. think about it. if im busted growing a couple plants in my house its possible for them to take my house. after they take my house they are going to sell it and make a profit. same with your car. people say that by making weed illegal your wasting resourses. but the truth is prohibition is wasting the average mans tax dollars but not the DEA's. thats there income. thats their paycheck. and the greedy fucks will do anything to keep it. i think that our efforts should be split. by falsifying the physical effects of marijuana they scare that average man into accepting the money being taken from him. we need to focus on educating the average american (not the DEA) that pot isnt harmful. this way the average man will not accept where his money is going to. what we need to do with the govt is call them out on the fact that they use marijuana directly for the purpose of creating revenue and force them to answer for what they have done. force them to come up with a reason as to why its ok to take a person personal property and then sell it for profit.

Apparently hashish/weed became illegal internationally in 1928 at League of nations (formerly United nations) 2nd opium conference ,these conferences coming as result of western governments worried about opium use among it's immigrant populations (mainly Chinese railroad workers in the USA) and weeds illegal status came into being as some sort of compromise to the Egyptian or Morroccan delegate over the banning of opium...apperently

and it wasnt internationally....i dont know where you people get your "facts"

No, you can't sue the government. Well, you could, but the government would be judging so technically it would do no good. Though, if one was to get together an army of recreational drug users and other people who aren't fond of the way the government is going, and get a bit of money to afford a few nuclear weapons and a hell of a lot of guns, I'd say it would be possible to start a second American Revolution, and probably win it.

okay its possible but you'll need about 100,000 people suing the gov't at the time to make it effective since its a democratic gov't. now yes about the dea part but they can still make money off crack, coke, meth, and all those other drugs. marijuana should be legal but the reason its illegal is because its being sold in the streets and gangs make profit off of it. ex. most of the bud brought to california and into texas is from the tijuana cartel and the mexican mafiax3...that is why its not gonna be legal anytime soon.

Sorry to tell you all this but yes we have the right to sue the government. It only took one biatch to take it to the supreme court and take prayer out of the school system. WE THE PEOPLE need to read our constitution. You have the right to ingest anything you want and that means drugs. It's there read it. Our fore fathers made it your god givin rights to freedom BUT our government has gotten out of hand. The Constitution states that if it gets out of hand WE THE PEOPLE should scrap the whole system and rewrite it to suit the PEOPLE now. Our government is so strong with military it will take ALL THE PEOPLE to change it. Drugs like pot were made illeagle when they found a way to take machine guns away from the old gansters. In order to have a machine gun you needed a tax stamp because we are allowed to bare Arms. How ever when you went to get your machine gun tax stamp , you had to have your gun in hand. Unfortunately there were no stamps made by the government on purpose. So you were arrested. The supreme court upheld this law. Later during reefer madness they had the same idea and the supreme court upheld that ruling too. There went the drugs.
I was busted in 2006 and went to check on illeagle substance tax stamps. Guess what. They did not have them, AND to buy them you had to have the drugs in hand. BUSTED.
23 years ago High Times and NORML would have pot leagle in a few years and put their selves out of bisiness. Right my ass . It's big money that rules not the CONSTITUTION. Read up peeps.

MastaChronic is right, logging/paper companies and Dupont Oil I believe got to workin' on basically tearing down the hemp industry and one of their points being that marijuana is an addictive dangerous drug used by blacks and that got the ball rolling towards the "War On Drugs" which wouldn't be so bad if it wer just about drugs other than marijuana, but they just group marijuana into that category so if anyone argues against it they call them a drug user and it creates a worse image of what they actually are creating an entire world of deception and deceit jailing many and ruining peoples lives and creating a pseudo-gateway effect ruining even more lives and many dead all started by a almost harmless way to get ontop of the market and one very long sentence...
