12 Plant Limit For Caregivers

At 3:30 p.m. today, the Denver City Council will consider zoning language to limit the amount of medical marijuana grown in residential locations. Some advocates believe this measure would severely restrict the rights of MMJ caregivers in Denver -- among them Colorado Coalition for Patients and Caregivers' Robert Chase, who's shared his objections with city council. Not that he thinks his complaints will make any difference.

"They're well on their way to ramming it through," Chase feels.

The council member taking the lead on the MMJ change is Jeanne Robb, who told Westword last month that she "supported our regulations for the dispensary model in our commercial areas, and even in some of our mixed use areas, because I thought it would get the growing out of our residential areas -- and I think it's more appropriate to have it regulated in business areas than to have unregulated home grows in our residential areas."

Robb said she decided to act after dealing with a grow "just off 7th Avenue in our district. It had 68 plants, and it took me four to five months to finally get it moved out of a residential unit. I went to law enforcement, to the DA, to city attorneys, to building inspectors, and said, 'Why does it take us so long to enforce something that shouldn't be in our neighborhood?' And they said, 'Because everything is so unclear.' And I said, 'We need to have some limits.'"

​Amendment 20, the measure that legalized medical marijuana in Colorado, allows a caregiver to grow six plants per patient -- so Robb settled on a maximum of twelve plants per caregiver in residential areas. In her view, "that's pretty liberal, and it doesn't seem like a hardship," especially considering that larger grows "create mildew and odor for neighborhoods, and that can be a problem. Police have had seventy complaints from residential grows just since March.

It seems as though a lot of legislation is being pushed through in several states that in all reality makes it so you can only grow enough for yourself. I've got a total of 13 plants right now. 4 being harvested in 1-2 weeks, 6 clones that I picked up last Tuesday, and 3 seedlings from bag seed. The bag seed is more for experimenting than anything else, but in Cali I'm WELL under the commonly accepted limit of 99 plants. The crazy thing is you can have 99 plants, but you aren't supposed to have more than 8 oz of dried, cured, smokable product. If I couldn't get more than 8 oz off 99 plants, I think I'd give up growing!:pimp:

This is unneeded regulation. If a caregiver is only allowed 5 patients & themself for a total of 6 patients. 6 patients with 6 plants each that's 36 plants max! If anything, 36 should be the limit. Anything over that, then there should be an issue. Their example of a grow with 68 plants shouldn't of happened but I'm guessing that was before 1284.

The California Supreme Court ruled earlier this year that nobody has the right to place limits on the amount of medicine being grown. I have spoken to officers from 4 different local police departments and they all said that they aren't going to mess with anyone for less than 99 plants. If they catch them selling to unlicensed patients, they will take action, but if you are growing for yourself and getting rid of the rest at a dispensary, they won't bother you. Even ehwen they conduct raids, if they think it's a medical grow, they try to save the plants so they don't get sued for their value when the courts say they are within their legal rights.

I'm guessing they go with a certain amount of space instead of a limit on plants. It's really a code issue, not zoning.

Do you mean something like no more than a 10'x10' area? That would make more sense than limiting plant numbers to something like 12

I don't grow outdoors, just indoors. A 10X10' area is 100 sq ft. Indoors, you can grow a plant for every 1.5-2 sq ft. Some people even say you can grow 1 per sq ft. 100 sq ft will accomodate the 99 plant maximum in Cali. I wouldn't try more than about 70 plants, but I like a little space to work.;)

Thanks for all your Cali-related comments but here in Colorado we're limited to 6 plants per patients. A small caregiver is also limited to 6 patients. A smart caregiver would probably limit themselves to 5 patients plus themselves if they are also a patient....

So we need to grow bushes/trees here. I know some who do the tiny multitude of plants but it's not worth the risk...

I'm sorry to hear that they are so restrictive in Colo. I personally think the Cali limit of 99 plants per person, and caregivers can include your amount in their grow. This means that if I have my card and am a caregiver to 5 patients, I can legally grow 594 plants. I think that's a little much myself. On second thought though, I guess if you grow outdoors exclusively and ingest your cannabis through cooking or concentrates, I could see the need to have so many plants at one time.:smokin:

Thanks for being polite towards those people who might not be educated with regards to new/updated legislation, there are plenty of posters here who act like assholes while ignoring the money spent by the 'regulars'.

Just so you know, doctors can recommend increased plant counts if your personal issues warrant that.

So, there are a lot of growers who are using your logic of 99plants per patient in order to remain complaint. I'm pretty sure that growers would only push this when taking cuttings/clones or right at harvest/pre hash making, when there are more plants/cuttings/trim in the trashcan from harvest.

Your input is valuable to those who are looking to push their limits until there's a comparable supreme court case like the one you refer to.

I don't personally push the limit too much. My bosses are considering opening a caregiver collective and their lawyer recommends staying at 80 per card. No reason to be greedy right? Again, thank you all for being so patient with my stumbling into the Colorado forum. Is there anything that we California residents can do to help?

send some retired lawyers that want to work for the cause! :jointsmile:

I'm in my late twenties/early thirties, so I don't have experience with much more than consumption. Being legal for a year now has opened my eyes to this 'industry'. There is so much that uninvolved people don't know, it's humbling.

My only advice would be to get as many people involved in this industry as possible. For reasons that don't matter, it's pretty easy to get your medical card in Colorado. It's so weird to me that I know so many people who don't want to bother getting 'legal' even though they happily consume and buy on the black market. To be clear, I don't resell my meds. I guess my point is that the more people who see the benefits of legalization/medical use, the more acceptable it will become. One step at a time.

It's pretty special to me that 'patients' and consumers can now share all of their vast knowledge with everyone else, and it's all for the cause, and it's fucking legal! Shit, I remember reading overgrow in college. Now all that is starting to make sense.
