section 4(b) of amendment 20 says:
"For quantities of marijuana in excess of these amounts, a patient or his or her primary care-giver may raise as an affirmative defense to charges of violation of state law that such greater amounts were medically necessary to address the patient's debilitating medical condition. "
it doesn't mention anything about a doctor's involvement in the process....
have heard different stories about doctors being scrutinized for high-count edible gardens and charging extra for higher count recommendations.

If you go over the allotted 6 plants and are popped, it is my understanding that you then must prove why you needed more plants. In other words, the burden of proof is on you.
Will your doc come and testify on your behalf? If not, then I would not cross it. The department of health looks at higher plant counts more closely.

Cops laugh at higher count recommendations, they know how the game works. Chris Bartkowicz depended on the higher plant counts and look where that got him. I always crack up everytime I come across one of these guys that are growing 50 or 100 plants, is 21 years old, and the only thing wrong with them is migrains.

If a Doc is offering a higher rec for extra money, run. Otherwise, I agree with the other posts in the thread. I also don't know if they're going to believe an "edibles" defense after what they're doing to private caregivers in almost every other area. They gave the MIP people infinite plants, not primary caregivers.

I asked this once before, but, isn't the reason you need more plants is to produce edibles or an edible form of the medicine? Choosing not to smoke the medicine and using it in edible form, regardless of your qualifying condition, is the 'why' of extended plant counts, is it not? Obviously making edibles requires more plant material.
I thought this was the reason that the dept health is now RECOGNIZING extended plant counts?
In so far as the doctor coming to court, can't he be subpoena'd like anyone else and be required to show up?

Yes that is all true, the problem is that cops hate coming across grows and not be able to do anything so they will find any way they can to fuck with you. Whether that mean going through your trash looking for dead plants, weighing your trim, qualifying fresh cuttings as plants, whatever they can do they will do. The last 3 busts I read about all were growers with licenses but according to the cops they all were over their count. One I know was within their numbers if you went by the higher rec but no mention of that ever and I suspect that was the case with the others.

you can subpoena the doc, but he can say "i don't recall" on the stand.

That's interesting, because the last several busts I've read about were illegal home grows.
Care to provide links? I'm curious if cops are busting legal caregivers instead of illegal grows.
I hope it's clear I'm not 'wishing a bust on others'.

I'm sure in a year, when I'm growing for myself and 5 buddies, that my opinions will probably change with regards to plant counts, caregivers, MMC's etc. I'm sure it's scary as a caregiver moving forward. My first plant is better than anything my current caregiver provides. It's hilariously sad.
