Can an acupuncturist serve as a board member for a growers application?
Does anyone know if a DOM (Doctor of Oriental medicine--acupuncture physician) can serve on a board as the required doctor for the grower/producer application?
Also can a person working in a growing operation qualify as one of the medical marijuana card holders on the board?

Any MD or PA that is certified to prescribe medication in NM can recommend MMJ.

Nope - Only those who can prescribe meds can be the all-important medical person on the board- i.e. no acupuncturists, aroma therapists, etc... I see the DOH's point; they had to draw the line somewhere.:cool:

Be aware you do not have to prescribe drugs as a Chiropractor does not and can sit on the board.

Here's what the regulation states:
TITLE 7 HEALTH CHAPTER 34 MEDICAL USE OF MARIJUANA
PART 4 LICENSING REQUIREMENTS FOR PRODUCERS, PRODUCTION FACILTIES AND DISTRIBUTION

(D)(4)...verification that the board of the non-profit includes, at a minimum, one (1) physician, a nurse or other health care provider, and three (3) patients currently qualified under the Lynn and Erin Compassionate Use Act;
I guess it all depends on the legal definition of "Health Care Provider,: there is a list of Definitions in the Act, above the other language, but it doesn't define "health care provider." They really should add this to their definitions, I just assumed it had to be someone who can prescribe meds, now I have no idea.....?!:(

I do feel that it would only be fitting for doctors with herbal training to be allowed on the boards (naturopathic docs, acupuncutists, homeopathists etc.) MD's aren't trained in herbs, but since marijuana is harmless they won't be causing damage by thier lack of knowledge at least. It's good to hear that a chiropractor has been approved-- there is hope that other holistic docs may also get approval:thumbsup:. It may take work to break ground for it though.

I have a group of business men I ride with (Harleys and one communist that rides a Gold Wing) One owns 4 Health Centers in Tucson which sell vitamins and organic foods a retired Chiropractor he is in favor.
One of his ex-partners is a Chiropractor and a Naturopath MD (which is really rare) he does agree their is medicinal benefits. He does lectures around the world and anyone that keeps their Naturopath license once a year has to submit a study which he decides if it is a pass or go.
Unfortunately he says he would not recommend it for anyone he would go with other holistic methods. In his clinic there is an acupuncturist which I have used for a dislocated shoulder I believe he is in favor.
My Chiropractor which I referred to as my board member is in total favor and the reason he was willing to be a board member.
So not all natural healers are in favor just like any other profession it will depend on personal experiences until the stigma goes away.

In my mind it would depend on if they are an MD as not all acupuncturists are. The one I used was however that is not always the case.
When in doubt do not rely on the bar stool lawyers in the forum that think they know how to interpret the law. Send NMDOH an email to 1) Dominick V. Zurlo [email protected] or 2) Jeff Marshall, [email protected]
I suggest the [email protected] to follow the chain of command before going to the top. Personal experience it takes longer to get the director to answer I am sure he is very busy.
Some days they get back within hours some times within days. You must realize your dealing with a overwhelmed government agency so patience is a virtue.

The answer is no, unless the Dr. is licensed to prescribe narcotic medications. Chiropractors are can not prescribe narcotic medications, unless they happen to be a doctor who is also a chiropractor.

Is a Chiropractor a licensed MD? WOW Yes he is you can tell by his initials. D.C. DOCTOR of CHIROPRACTICS.

Yes I know DCs cannot prescribe drugs that has nothing to do with it. There are many "other health care providers" that cannot prescribe. If you still admittedly believe this then please quote it from the compassionate act.
With your reasoning if a prescription was necessary we in Az have already passed MMJ twice unfortuantely the wording was a doctor had to prescribe MMJ.
That is what stopped it from taking affect the last time as the DEA is the licensing body that gives doctors the right to prescribe. The DEA stated immediately that if you prescribe a schedule 1 substance and you will lose your license.

I think the question is misleading and your answer is both correct and incorrect at the same time... depending on the chiropractor.
"Health care provider" is a loose term the DOH likes to use. Don't be fooled by the use of this word.
If you submit a recommendation from a straight Chiropractor, it will be declined. Chiropractors can NOT write prescriptions for narcotic medications.
If you submit the same recommendation from a Chiropractor who is ALSO a doctor or health care professional that CAN prescribe narcotics, your application could be granted (depending on all other factors).
Again not picking bones, just trying to help.
I know because I submitted a recommendation from my Chiropractor two years ago, and it was denied.

That was the response on 2-17-10 again from Jeff Marshall the head honco at the time if he is no longer there.
I have not been in touch since March as I have been to slammed with my computer business to even worry about it.

Any health care provider can sit on the board of the nonprofit producer, but only practitioners with prescriptive authority can write the recommendation to use medical cannabis.
