Medical Marijuana Business Applications Demand Unprecedented Scrutiny

The state of Colorado has released its new state medical marijuana
licensing applications. There are two lengthy applications, one for Medical
Marijuana Businesses and one for Medical Marijuana Associated Persons.
Licensing fees range anywhere from $7,500 to $18,000 with an additional
$1,250 for every grow facility operated by a medical marijuana center. The
application was developed by a new entity called the Medical Marijuana
Enforcement Division within the Colorado Department of Revenue. Click here

According to attorney Jeff Gard, the applications "are quite detailed,
require substantial support documentation" and both the applications and

In addition to being lengthy, the applications require the applicant to
surrender all rights to confidentiality and privacy and to hold the state
harmless if the state should accidentally misuse the information. The
application contends that the "Medical Marijuana industry in Colorado is
one of the most scrutinized businesses in the state, because Colorado
citizens want the industry and everyone involved in it free from even the
hint of any corruption or deceit."

The applicant must authorize full financial, criminal, personal background
investigations. The applicant is also required to supply their federal and
state tax returns, copies of diplomas, divorce decrees, bank statements,
credit card statements, name and addresses of all their children,
employment history, details of all assets (cash on hand, cash in the bank,
stocks, bonds, real estate, and investments), details of all debts, and
fingerprints.

The Investigation Authorization form requires an applicant to "waive any
rights of confidentiality" and allow the state of Colorado to "conduct a
complete investigation" into the applicant's personal, criminal or
financial background "using whatever legal means" the state deems
appropriate. For instance, the applicant must authorize "any financial
institution to surrender to the Investigatory Agencies a complete and
accurate record of such transactions that may have occurred with that
institution, including, but not limited to, internal banking memoranda,
past and present loan applications, financial statements and any other
documents relating to my personal or business financial records in whatever
form and wherever located."

The applicant must authorize the release of this type of information, "even
though such information may be designated as 'confidential' or 'nonpublic'
under the provisions of state or federal laws."

The applicant must also "hereby release, waive, discharge, and agree to
hold harmless, and otherwise waive liability" to the state of Colorado "for
any damages resulting from any use, disclosure, or publication in any
manner, other than a willfully unlawful disclosure or publication, of any
material or information acquired during inquiries, investigations, or
hearings, and hereby authorize the lawful use, disclosure, or publication
of this material or information." So if the state of Colorado
"accidentally" publishes all your private bank records in the Denver Post,
you can't sue them.

The Cannabis Therapy Institute lead the opposition to HB1284, the state law
enacted in June that allows the Department of Revenue to set whatever rules
it wants to govern the medical marijuana program. We believe the flaws in
the current law are too numerous to fix, so we have proposed the Legalize

thus alleviating the problems for patients created by the current law.

well, there's a whole buncha reasons to stay small-time.

i don't think the vetting of a supreme court justice even goes this far.

It is beyond oppressive, I have known folks that used to work at Rocky Flats (made plutonium Triggers) and they never had to disclose even half of this. And worse yet the DOR has a year to go over these apps with fine-tooth comb, talk about data mining.:wtf:

This seems to be setup how Nevada was handling Gambling licenses for casinos in the 50's. Mafia family finds Mr. Cleancut to be front man on paper and you know the rest.

Teachers have to supply most of that as well. The financial information is required of every new business in the state. Compare the MMC application to the application for a liquor license, also available on their site: they ask for the same things. The price of the license is the most objectionable thing, IMO, although I don't think it out of reach for most businesses. Some level of scrutiny is appropriate: we just have to find that level.

Really? I've owned two S-Corps, a C-Corp and a few sole proprietorships, never had to provide the state with any personal info.

Read the app... they're asking for the business accounts information not personal. They ask for the names and account numbers of the operating and investment accounts the MMC will use. They also ask the same for any loans the center might have contracted.

HiPop, re read the app yourself.

It is all personal banking information.

"List below all accounts, foreign and domestic, maintained by you, your spouse or dependent children, or by any person or entity on your behalf in which you have a current, or anticipate a future benefit."

I own two businesses in this state and never had to provide that kind of information when i registered them. And we thought it was bad when Bush ordered all the wiretaps, this is worst than anything Orwell could come up with with he talked about "Big Brother." It's now more like "Big Mother$#@#$$%":wtf:

I hate to tell you this, Bullshit! maybe the Bar goes this far for attorneys almost, I had freinds that worked at Rocky Flatts and had access to nuclear material and they never had to go through this kind of scrutiny.

I'm a teacher in Colorado and I had to give fingerprints, criminal history, personal background investigations, academic records and about a zillion other things. I also had to obtain a college degree. On my tax forms I have to give information about my [nonextant] dependent children.

I think what you say is possibly true. Rocky Flats closed twenty years ago when employee scrutiny was much more lax than today. A google search indicates that standards are more strict now in nuclear facilities, civilian and military.

...unless you're talking about the Rocky Flats Lounge, which was an ok place to get lit.

Well yea, you're around kids all day. Not to mention you are comparing apples to oranges, one is getting hired as a profession, the other is attempting to become a small business owner. Small businesses are what keeps the gears turning in this country and should never be discouraged as the case here.
