Page 59 (5) (b) of 1284--"Two or more primary caregivers shall not join together for the purpose of cultivating medical marijuana."

married people are joined together for the purpose of marriage. is this a right lost when married? when 2 caregivers with a full load get married, would have the patients have to go?
they ARE going to have to decide what to enforce. If I get popped and have the interpretation of one of the sponsors of the bill.... perhaps I would have a better defense.
It's really fucken great this regulation cleared everything up, and is protecting so many!

Agreed--it's B.S--It's forcing medical marijuana patients to buy from a certain place--which in my opinion is unconstitutional.

Romer is WRONG, I have talked with my uncle who most of you know is a DEA agent and I have talked with Lawyer. Husband and wifes are not allowed to have 5 patients each. Furthermore a husband and wife are not even allowed to grow together

The letter will do you know good. It will be rules as hersay unless you get Romer to come to court on your behalf and say he wrote the letter. You and I both know that will never happen. The DA will say it is a bs letter and Romer never wrote it

For one, I don't trust Romer! He left a very key part of the question unanswered, "I hear we are no longer allowed to grow together - is this
true?"
His answer does not specify whether husband/wife can grow together. I think it's deceptive.
Did he answer any of the other questions?

you are all right. I'm not looking to increase my plant count now (especially mid summer!), and we are down to 5 patients total. I doubt I'll be using his advice unless the courts rule the same way (agian).
maybe we should get this guy to a function somewhere, where he can be on the video record answering some tough q's about gray areas.

answer: You will need to coordinate this issue with CDPHE, but I believe only those that YOU approve/accept as patients will qualify.

answer: Our regulatory framwork This decision was a public policy decision, made way over my head. However, here is something for you to ponder.....if caregivers were allowed unlimited patients, why would anyone be regulated as a Center/dispensary? (Centers are created by statute and caregivers are created by the Constitution...the two are NOT the same) I hope this helps.... Take care, Matt

Nope--what I mean is there are many caregivers in this state that have over 5 patients. According to what our interpretation of 1284--the caregivers are going to have to cut their patients down to 5--by July 1, 2011.
If you're unlucky enough to be one of the one's that your caregiver cuts off--you would be forced to find another private caregiver or go to a dispensory. Since caregivers are not a matter of public record--you would not know who to contact to provide those services--so most would end up in a dispensory--paying 3 times as much for more than likely--lower quality.

There is nothing in bill 1284 that states that a husband and wife cannot grow together for their own personal use.
What it is saying is that two caregivers cannot join together--and that caregivers are limited to 5 patients.

This is the part of HB1284 that effects myself and my family the most. My husband, myself, and both my son and daughter are patients. Only my husband and I live in the same house but my son and I were combining our caregiver/growing rights.
It is my understanding that both a husband and wife can grow their 6 plants each but only one of them can be a caregiver for others. So... the way I see it I can be a caregiver but my husband can not. I can have 5 patients so that is 30 plants for patients, 6 for myself and then my husband can have 6 plants as well.
This gives us a total of 42 plants which for my situation is just fine. I can no longer combine my grow with my son's however.
It is also my understanding that assigning a primary caregiver does not mean you can not grow your own 6 plants. Any other input on these situations?

I think the holly-rollers in Colorado Springs would picket the DPH&E if they refused husband and wife from "joining together." LOL
HB10-1284 states the DPH&E can provide an exception to a caregiver for the 5 patient rule, can consider the distance a patient lives from a dispensary, etc.
If you think like a public health bureaucrat you should be able to design a compelling exception request the DPH&E would find difficult to turn down.
a.) It will be difficult to turn down a request from a seriously ill patient. b.) Doc recommends his patient stays with their present caregiver due to positive health gains. c.) Caregiver grows an unusual variety that dispensaries refuse to grow due to the degree of cultural difficulty. d.) Caregiver makes an eye-wash not available at dispensaries. e.) Patient doesn't drive and lives too far to walk to a dispensary, etc.

And Amendment 20 states that the DPH can study and add new health ailments for MMJ which has not happened once in 10 years. Anyone who thinks they are going to give anyone an exception from 5 patients is dreaming.

I am thinking only one caregiver per house.
NOW, I am also thinking there is no way that anyone's rights under the constitution could be diminished by who one lives with.
So, and I don't think this is pushing it...
in one house, 1 person can be a caregiver for 5 people. That person can also be a patient - so that is 6 * plant count for just a caregiver who is a patient and his/her 5 patients.
NOW, if that caregiver is married, if the spouse is a patient, they get their 6. Anyone else that lives in the house, gets their six.
I highly doubt any jury will find otherwise considering the gray area that is 1284.
Even without increased plant counts, a married couple could certainly be up to 42 plants. Throw in a couple edible rec's in those 7 people, and you'll have your clones covered.
that's my dumbass opinion, but sorta thought out. Don't take my advice without consulting an attorney, especially considering I only even have room to flower 15 ; :stoned:

You can grow for 5 plus yourself. 36 plants total.

It is my understanding that you can have 36 plants total.

30 plants (6x5patients)
