Should I be worried about a warrant?

A few officers showed up at my house. I stepped outside.
They told me that they had received some 911 hang-ups from this address, but I don't have a land line, so the calls didn't come from here. They said the calls came from a woman. Hah, definitely not one of those in my house.

They wanted to enter the house and take a look around to make sure I was the only person. I refused entry on the basis that I'm the only person living here, and I don't even have a land line. They had dispatcher check out the call again.

While waiting, they tried grilling me as to why I wouldn't let them in. I stated that it was "my home", and I appreciated what they were trying to do for this woman, but they simply had the wrong address, therefore I didn't see a reason to let them in since I was confident they would find out this is a mixup.

One guy asked why I was acting so nervous if I had nothing to hide, and said "you could be growing marijuana in there". I laughed, and pointed to my dead tomato plants out front (I have no idea why they died) and said I'm not the green thumb type. They just nodded, didn't push the topic at all.

Dispatcher came back and I heard her clearly say over the radio "the call was actually from a MagicJack" in another town entirely (I assume it was a recycled number that used to be at this address). They pretty much said ok, asked me what I did for a living, then took off.


My question is this: Since I denied them entry, is this grounds for a search warrant, or even just grounds for having officers poking around my residence?

And I don't know much about the MagicJack, is it entirely possible that this really was just a mix up? Or should I be concerned that this is some kind of weird knock and talk tactic?

My parents are the only people who know where I live. Nobody comes over except for them. I've only been here a little over a month. And absolutely nothing here is in my name.

so why do you think you have a warrant???? is there something you did beforeu moved that u might have a warrant??? cops dont just ask about a 911 call from a home... why is everything in somebodys name other than yours??? iam just trying to fiqure out why u are paranoid!!! you did every thing right as far as when the cops came knocking at your door!!!! lol thank god for the dead tomatoe plants lol if you r growing i would get rid of them if you do have a warrant out for you... if you know for sure you dont and i mean know for sure then you shouldnt be to worried! good luck :stoned:

No, no warrants, I've had no run-ins with the law. Sorry, I should have specified search warrant...

The cops were digging for info. And them saying you could be growing is a clue. Now they do not have enough to get a warrant but you are very lucky they didn't say they smelled something and want to check it out.

When it comes to cops the more pussy you are the more their NAZI tactics work on you. You must be strong and stand up fpr yourself.

Some one sent them to your house and in a very strange way. Cops do not make mistakes and if they were trying to save someone well Jeffry Dolmer just ate another.

I don't think they will get a warrant but no matter the damage is done YES.

They get a warrant and bust you.
They came by for a knock and talk and you went freacky and they smelled something and bust you.

Or this is the one they laugh about all week.
They came by with a stupid story no one would believe and wanted to NAZI search and sence you were a nervous little nazi they don't push it but being sooo nervous they got you do destroy it all by yourself.

A fine days work for local law enforcement NAZI's.

I would move em, if at all possible, or conceal 'em as best I could, if not, and put some of the dead tomato plants inside in the house in a makeshift 'failed hydroponics experiment', so that when they knock, you can make 'em feel sheepish a second time, and sue 'em for harrassment.

Well, there's nothing illegal going on here at my home, but there are some other issues with the police that have already gotten some harassment thrown our way.

I should point out I just moved into a smaller community outside of town, really just because I got tired of having neighbors. And not having to deal with crap like this.

I really did refuse entry on the basis that this is my home, and I'm allowed my privacy. It pisses me off being treated like some kind of unwanted guest on my own property.

I just feel like this was some kind of poking around by the PD, because of how the encounter went: 911 hang ups, that line is linked to my house, they want to search the house based on this, i refuse, they check number, while waiting they accuse me of acting suspicious (yeah, I was minding my own business, not even breaking the law, and now I have guys with guns banging on my door, kind of sets off alarms), and then they get word back that they have the wrong address, they leave (but not before asking what i do for a living).

I don't have anything to move out, but even disregarding the fact that there is no physical evidence, should I still be worried that these guys might still find a way to come ripping through my HOME?

I feel like I can't get away from these guys, yeesh!

I was able to verify that there was somebody here at this house before me with the name of the person they were asking about. I was able to get a hold of them and have them change the address registered on their MagicJack.

I guess my worry now is that they might come poking back out of general suspicion, but at least I know that this wasn't a knock and talk tactic.

One of the things that we all have to start getting back to is making sure our cops are PEACE OFFICERS instead of POLICE OFFICERS. And standing quietly, correctly, on our civil RIGHTS.

Tell them you're an IRS agent and ask if it would be ok if you came to their house and search it.

There are no grounds to obtain a search warrant. The dispatcher confirmed it was from a MagicJack number in an entirely different state.

There is no reasonable cause to come back with a warrant. Just because you don't let them inside and search, doesn't mean shit. It's your place of dwelling, you were minding your own business, and nothing you did was warranted for a search.

In the eyes of the law, your expectation to privacy is one that society is prepared to recognize as reasonable, and nothing you did was unreasonable.

I recommend you get a copy of the book, Marinuana Law by Richard Glen Boire. It explains in great detail how to react and what to expect in your situation. You did exactly what should've been done.:thumbsup:

they have no reason to enter in the house without a warrant and they can grill you all they want....all you have to do is answer them with the info about the 911 call. they would have to obtain the warrant from a judge and have to have probable cause. in the article below the police obtained the warrant and then were able to seize things.
