Medical marijuana bill changes rejected by House, special committee to be formed - Denver News - The Latest Word

House rejected the anonymity of grow operations. Now it goes to a special committee to be approved by tomorrow night.

I heard that the senate rejected the special committee, and that the house would likely pass it with the senate changes.

then I heard it passed and was on the way to Ritter, but I can't confirm that yet.

I think that making this info public would actually create the situation they say they are wanting to avoid. You can assure that thieves will be carrying that list around looking for good targets. Scary stuff!

I really do hope the judges do not have a blatant disrepsect for our constitutional rights as these pathetic politicians have shown countless times. Thank god that the people of this state voted in Amendment 20, I can't wait for these same people to vote out EVERY politician that has supported hb1284. Patients, caregivers and dispensaries are keeping track of the politicians that are screwing us. Come elections there will be plenty of mmj articles pointing out who NOT to vote for. I personally can not wait to get my vote counted. Once this passes and the people fully realize how bad the politicans have screwed us, it will only be a matter of time before we have sensible politicans making sensible mmj laws.

I think the numbers are growing so fast that we will be a big enough force to vote them out of office and get people in there that are actually compassionate about mmj. I've called almost all of the senators and left messages saying I'm going to vote them out of office and I'll tell everyone I know to do the same if they don't change their vote on hb1284

This morning Rep. Massey moved that the House concurred with Senate
amendments to HB1284. I made a substitute motion to send it to conference
committee to consider some of the Senate amendments. That motion passed
by just one vote. I have just learned that the Senate will not agree to a
conference committee, so evidently a member of the House is going to move
to reconsider the decision to send it to conference.

I do not believe the votes are there to kill the bill. There are too many
members of the House whose constituents are concerned about dispensaries
popping up where they don't want them.

I am still a no vote, but I don't think I will be able to change many
minds on the matter.

Well I hate to be that guy that starts his posts with, "I've been saying this since day one." But oh well...

I remember back in November saying that the appearance of dispensaries on every corner in Denver is going to FASTTRACK them to some harsh legislation we don't want!!
It's hard to contain the entrepreneurial spirit obviously, but I wish all of our second-rate dispensaries would've maybe never opened up and just done under-the-radar grows...

This really is the reason that the legislation will not fail. Shit, I'm 100% for pot, but I'm a little disgusted at all the dispensaries I see when I drive down certain areas. I mean there's fuckin' neon pot signs everywhere. I totally understand the average citizens concern that this is a runaway freight train. Not many people want to see their neighborhood turn into a coffeeshop district!!

Just playing devil's advocate here, but I think that our explosion caused this backlash. Too bad we couldn't have done some regulating on the front end... maybe making dispensaries a little harder to open up... rather than legislating on the back-end and making them impossible to run... therefore closing most of them down...

But that IS the intent really. They want less dispensaries... so they are getting there way... they are just taking a big shit on a bunch of entrepreneurs as they do it. Bankrupting many and robbing them of their lifesavings. Way to go!!

since i did'nt make it on the meeting day tho i wanted to be there.i guess all i can do atm is give ideas for us/you to work with that will do something.

i for 1 think that the shops/caregivers need to pool some money for a tv ad letting the people running for office in nov that we have their number and for the ones on the outside that want to make office they need to back the people and write bills that will be pro the people not pro the leo/gov/big biz.

let them know we will stand behind and back the person that backs us.i think these people that are running are somewhat the same as the rest in office because they think they can do the status quo and no biggie.i think we need to let it be known that we are awake and are watching,no more rail roading us anymore.you either are for us or your not bottom line.we need to draw a line and tell them to pick a side.no more standing on the fence.

they are going to use what you said here to not only stop that part of it but also to further the true agenda which is to take back the right that was voted on.maybe not directly but make it so fuck'd up that the leo and state will be able to do as they plz and you will have no say in it.i say if this happens we all know deep down the only right way to act from there.just us knowing what they are doing is'nt right at all just talking and bitching won't cut it.i say we are in the first stage of our goal here.we are trying to do the right things by writing letters and so on.if that don't work we move to stage 2 "lawyers" then if that does'nt work......research history......other than that i say be happy as a pawn that you are in all of this cause it's either stand up or lay down...

the way i read it is no.but they may have left it open for leo to use too?the way i read it if you stay really small 5 and under nothing changes as far as it goes now.the only thing i see that may have changed on that lvl is if you go to a dispenary to sell any they will keep records of all you do with them?

call me crazy however i think the political agenda is to create illegality where ever they can. cannabis has been the bread and butter of the penal system and its got to be hurting it financially. has anyone noticed the bumped up police force lately and now the one mile over law that im sure none of us appproved. its going to get worse im certain.

Only a dispensary grow op can be licensed so if you don't have a licensed dispensary you can't be a caregiver with over 5 patients or have employees running the grow op. I'm pretty sure you have to be partnered or under contract with a dispensary and then the grower would be paid for his work somehow. I'm willing to bet the dispensaries screw the growers and make more profit, then mark up the prices again and make even MORE profit.

I think thats correct, although I think they are going to setup a caregiver registry whereas caregivers will have to get fingerprinted and background checked, no felonies within the past two years I believe.

I think if you want to grow for more than 5 patients you will be forced to 'team up' a dispensary as an off site grow operation.

Who's going to pay the 10K fee? I bet the farmer.

Watch the 'new gig' on the block, """Pay the 10K 'franchise growing fee' and join our dispensary and grow legally!""" And then we will TELL you what we will pay you for it.

10K at 200/zip (or less probably) will be giving a free QP to them each month to pay for that.

All of this gives so much power to the dispensaries who survive. I believe the price is going to quickly rise in the dispensaries and now they have the reasons to justify it. The ONLY thing keeping the price in check at all was the small and medium careproviders/dispensaries-pseudo or otherwise, who could kill the dispensary prices, no longer the case.

I've always believed this was about putting some power in the hands of a common man who works hard and staying away from the pharmaceuticals. The dispensaries have simply replaced them.

I feel very foolish, as I've always supported dispensarys and done business with some of the biggest, and that's who basically lobbied me out of the industry. I thought they would be a way to eventual legalization and turns out, so far, it's the exact opposite. They are the reason for all of this legislation.

I suppose it's back to the 9-5 grind and prozac.

As a small care provider I feel like they are simply ripping my pursuit of happiness from me and my patients.

It did. I know of one dispensary owner who behaved so stupidly and arrogantly at a meeting with County officials last fall that they couldn't pass a moratorium fast enough.

It's easy for me to read between the lines to know what the law is, but is that a national law or a Colorado law?!? That is fuckin' ridiculous..

Most cops in CO don't even look twice if you're doing up to 10mph over!! This law has nothing to do with speeding!! You're right it's just to basically give them more legal defense to pull ANYONE over. They don't have to have a reason to pull you over anymore!

As most people know, speedometers are not 100% accurate (neither are radar guns). Your speedometer may say you're going 35mph, the speed limit... but you may actually be doing 36. The gun may be slightly more accurate and pick up 36. So now he has the right to pull you over?

Also, because of this inherent inaccuracy (compounded by the inaccuracy in the cop's radar gun as well) the cop will always have an excuse to pull over someone doing the speed limit!! If you are going 34-35mph, and he wants to pull you over, he can now easily SAY that you were going 36mph even if he got a reading of "35mph". He now has that uncertainty to use to his advantage. A 1mph increment is easy to fudge and most cops would probably feel justified in doing so if they found drugs in the car!! Hell, when I set my cruise control the speed probably varies from 2-3mph as I go up and down hills and the grade changes...

This is nuts to me! I always thought the cops gave you that 5mph over kinda because of this...

the last bill was that dispensaries must produce 70% of their own leaving 30% to be purchased if needed. how all of this will enforced is a mystery (call scooby and friends) because i cant comprehend the task force needed to detail all of these transactions. probably why they want to cut down on dispensaries. i see this battle going on for a while though, as neither side wants to concede. the little items have been agreed on, now the beefier issues are the real fight. like i said new law. i just heard about it within the last month. it was even posted on a reader board on I25 saying "75mph means 75mph." as for the rest of your statement they dont care, you were not there to vote on it, none of us i doubt were there. this is how they do shit under our nose. keep it quiet nobody shows up for the hearing, BAM its a law. of course im no expert it just seems until its on the news most dont know. its not about drugs being found its about money, thats all these traitors want power and money.

I sent this copy below out last night I guess more got hit last night.. As far as I know its on a catalogue and compliance nature, but please make sure u r In line. :::::::::::::::::::::::::::::::::::::::::::::::::: :::5 or 6 clinics were raided today along with many grow operations over the last couple days here in the springs. Not that we have anything to worry about. Just know its coming down. The law has been defined and now law enforcement has direction. They have no knocked and kicked down the doors, made copies of all patient records and city sales tax. They also took samples out of every jar to catalogue and trimmings of every plant along with sales records. This as we know is one of the problems with HB1284, it gives broad police power and limits our rights. Watch your six!!!

Colorado Springs police searched seven medical marijuana dispensaries in the city Wednesday as part of an ongoing investigation, said Sgt. B. Poole of the region's Metro vice, Narcotics and Intelligence squad.

No arrests were made and Poole declined to say what police were looking into, saying it was an ongoing investigaiton and would be reviewed by the 4th Judicial District Attorney's Office before any information could be released.

Sunshine Wellness Center, a downtown dispensary, was not among those that were searched, but an employee said she heard police were checking that the growers were complying with state laws regarding the number of patients dispensaries can have and the plants they can grow.

Tanya Garduno, president of the Colorado Springs Medical Canabis Council, which represents patients, caregivers and dispensaries in the area, said the group has been meeting with law enforcement officials to discuss mutual concerns and was surprised by the searches.

"We were given no indication of an investigation," she said Thursday. "This pretty much blind-sided us."

The searches were conducted the day after the Legislature gave final approval to a bill regulating the medical marijuana industry.

HB1284 would create state licenses for medical marijuana dispensaries and allow local governments to regulate or ban dispensaries outright. The law, which Gov. Bill Ritter is expected to sign, also would set state residency requirements for dispensary owners, prohibit kickbacks from dispensaries to doctors that refer patients for medical marijuana and tighten restrictions on minors using medical marijuana.

Garduno said she suspected 4th Judicial District Dan May, an outspoken critic of the medical marijuana dispensaries, had a hand in the searches being conducted so soon after lawmakers approved the new regulations.

DA's spokeswoman Kathleen Walsh denied that May played a role in orchestrating the searches, saying the office only become involved if someone is arrested.
