When I got my referral I let the dispensary send out my papers. I have no proof of mailing because I ASSumed since they did it I was cool. So obviously I need to ask them for that but in the mean time I can't go to any other dispensaries?

ask them for it or you can switch. however on the health dept. website you are supposed to mail it yourself. confusion in the mmj arena is plentiful.

That is correct. You're supposed to mail it in yourself, and they make that very clear I think. Of course not everyone knows where to go to get the info. I guess some just go by whatever hearsay.Quote:

Thanks guys - thing is, I did check out the health dept. website first and, again, ASSumed since they offered to do it I must have been mistaken when I thought I had to do it myself. So now what?

Some dispensaries don't ask for proof of mailing. If they do, tell them what happened or just go to another one. It's not like there is about 300 in the Denver area to check out. I would imagine there's a couple who don't care as long as you have a Doc's recommendation. Technically that's all thats required, it's voluntary to register with the State. I know guys who just have a letter from their Dr and it's what they carry around with them. Of course they don't visit many dispensaries so not sure how they works for them at those places.

No one can MAKE (does that somehow make it easier to read or something?) you register. It's only as a means to provide an easy way for law enforcement to verify your recommendation. Read the Constitution & the Revised Statues. It's all in legalise but it's plain as day in there. If you have a debilitating condition and a doctor's recommendation - no Colorado court is going to sentence to jail. Might rack up some legal fees, but you'll get off. The po-po might give you some headache, but you'll still get off. It's not the way I would go about things, but some people are paranoid about being on any registry any where any kind.
The thing I've heard is best is to ask for a return receipt. This will show that the registry actually received what you sent.
No, I highlighted the part in my first post so that you would understand thats what my question was about. I've never heard this before and given that my application was rejected over some stupid penmanship issue (not my penmanship - the notary's penmanship) and a notary stamp - I'm a little pissed at the registry and if I can LEGALLY purchase/posses medicine without registering and giving the state my money just to be a patient - I'll do it. As far as I'm concerned, the registry can suck my sweaty ball sack. Can't believe they rejected my application because the notary signed my paperwork and accidentally wrote a little ink over her own damn stamp. :mad:Quote:

Can you go and get a reciept from the dispensary showing that you paid all the fees at least? I bet the dispensary put your return address-how could the registry tell if you didn't send it in? I wouldn't worry about it, but in the future I'd do it yourself :)Quote:

Believe me. I wouldn't go that route as far as not registering. I think it's stupid not too, but it does not state in either the Constitution or the Statues that one MUST register. It only states how one goes about registering & why (for LE). Like I said just carrying a DR's recommendation is probably going to land you in court, but you'll get off.

Dont really understand why proof of mailing is so important. Its just a reciept from the post office that could be from anything. It doesnt say on the reciept what you mailed. So you could go mail anything certified mail and keep the reciept, or just copy someone elses.
Not exactly correct. The reciept is linked to the address you mailed it to. So yes, you could mail a blank envelope to the CDPHE but I doubt most people would bother. Granted a dispensary would have no way of knowing if the proof of reciept was actually to CDPHE unless they tracked it online, but it is to cover their ass that the patient has done everything according to hoyle.Quote:

There will always be methods of abuse in any system. This one is no different. Ofcourse, the more difficult they make getting "legal" the more chances their will be for fraud and abuse. The system is terrible now, and if the current bill passes in it's current state it will be worse. It will cost the patient, the state, and dispensaries more.

I got a denial for one of my patients 6 months after we sent it in because of a small technicality.

copobo - you mention one of your patients getting rejected on technicality - then what happens? I am a 54 year old happy after all these years to finally be a legal user of medicinal herbs, hoping my app (in two months now) doesn't get snagged on some minor thing - but if so, then what happens? Does patient have to get doctor recommend all over? Can I re-sub original app with technicality corrected? Thanks for any info - just in case! You sound like you care about your patients alot - where are your services located?
You can get rejected forlots of stuff,wrong color ink being the most common, not sending your app and papers via certified mail...not just a stamp slapped on! Forgetting to include copy of id.The weirdest one...they sent of the COPIES of the Doc app in...rejected for wrong ink...WTF? Its a copy! I think the temps they hire to process the apps are smoking better than my patients. So a few folks have replaced the b&w copy in their send off kits for color copies instead. Not sure how it goes, being a caregiver is easier than a patient sometimes.
